What it does
This bill would subject owners of real property, other than owners of one-, two- or three-family residential real property occupied by the owner and used exclusively for residential purposes, to a maximum civil penalty of $5,000 if they fail to complete sidewalk repairs as directed by the Department of Transportation. In addition, this bill would subject such owners of real property to a maximum civil penalty of $5,000 upon being issued notice of a sidewalk defect that poses an immediate danger to the public if such owners knew or should have known of the defect unless the Department of Transportation determines that the failure to address such defect before notification is reasonable under the circumstances.
