VETO MESSAGE - No. 77 TO THE SENATE: I am returning herewith, without my approval, the following bill: Senate Bill Number 923, entitled: "AN ACT to amend the election law, in relation to changing party enrollment of voters where the enrolled party contained the word "Independence" or "Independent"" NOT APPROVED This bill would remove the party affiliation for any voter who is currently enrolled in a political party that includes the words "inde- pendent" or "independence." This legislation is not necessary, as what it requires is provided for expressly in Election Law 5-302 (1) with respect to any voter enrolled in an inactive party. Additionally, in August of this year, the U.S. Court of Appeals, Second Circuit upheld the prohibition of the use of the word "independent" or "independence" as part of the name of any future recognized political party or independent body appearing on the ba...
