An Act to renumber and amend 106.276 (1) (c) 3.; to amend 106.276 (1) (c) 1., 106.276 (1) (c) 2. and 106.276 (1) (c) 2m.; to create 106.276 (1) (c) 3. b. and 106.276 (1) (cm) of the statutes; relating to: the commercial driver training grant program.

Current law provides for a commercial driver training grant program. Under the program, the Department of Workforce Development provides grants to individuals or other entities that provide training leading to an individual receiving a commercial driver’s license (CDL) in this state, if certain requirements are satisfied. These requirements include that the training satisfy the entry-level driver training requirements established by the Federal Motor Carrier Safety Administration (FMCSA) and that the applicant be a provider listed with the FMCSA and provide the training at an in-state facility operated by the applicant.
This bill expands eligibility for grants under the program to applicants other than training providers. Under the bill, therefore, an applicant that pays for a third party training provider to provide training may receive a grant under the program. The bill requires any applicant to have at least one facility in this state, but eliminates the requirement that the training be provided at a facility in this state. The bill retains the requirements that the training meet the FMCSA requirements, the training provider be listed with the FMCSA, and the individual reside in and receive a CDL in this state. Finally, the bill expressly prohibits more than one grant being awarded per individual trained.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Section 1. 106.276 (1) (c) 1. of the statutes is amended to read:
106.276 (1) (c) 1. The applicant provides, or pays for a 3rd-party to provide, to an individual who resides in this state training in the operation of commercial motor vehicles that satisfies the requirements of 49 CFR part 380, subparts F and G.
Section 2. 106.276 (1) (c) 2. of the statutes is amended to read:
106.276 (1) (c) 2. The applicant or other 3rd party described in subd. 1. that provides the training is listed on the Training Provider Registry (TPR), as set forth in 49 CFR part 380, subpart G.
Section 3. 106.276 (1) (c) 2m. of the statutes is amended to read:
106.276 (1) (c) 2m. The applicant has a facility one or more facilities located in this state that is listed in the Training Provider Registry described in subd. 2., and the training described in subd. 1. is provided at or through that facility.
Section 4. 106.276 (1) (c) 3. of the statutes is renumbered 106.276 (1) (c) 3. a. and amended to read:
106.276 (1) (c) 3. a. The Except as provided in subd. 3. b., the individual for whom the applicant provides who receives the training under subd. 1. obtains an initial commercial driver license, as defined in s. 340.01 (7m), in this state after March 23, 2024.

Section 5. 106.276 (1) (c) 3. b. of the statutes is created to read:
106.276 (1) (c) 3. b. If the applicant is not a training provider as described in subd. 1., the individual for whom the applicant provides training under subd. 1. obtains an initial commercial driver license, as defined in s. 340.01 (7m), in this state after the effective date of this subd. 3. b. .... Section 6. 106.276 (1) (cm) of the statutes is created to read:
106.276 (1) (cm) The department may not award more than one grant with respect to a given individual who is trained as described in par. (c) 1.
