Sunset and Repeal Date Amendments 2026 GENERAL SESSION STATE OF UTAH Chief Sponsor: Todd Weiler House Sponsor: Andrew Stoddard LONG TITLE General Description: This bill modifies certain sunset and repeal dates. Highlighted Provisions: This bill: extends the sunset dates for the following: the State Weed Committee; the Bears Ears Visitor Center Advisory Committee; the Land Use and Eminent Domain Advisory Board; the Rare Disease Advisory Council Grant Program; the Newborn Hearing Screening Committee; the Mobile Crisis Outreach Team Grant Program; the Behavioral Health Receiving Center Grant Program; the Child Care Advisory Committee; the Health Care Providers Immunity from Liability Act; the Speech-Language Pathology and Audiology Licensing Act; the Hearing Instrument Specialist Licensing Act; the Behavior Analyst Licensing Act; the Behavioral Health Crisis Response Committee and associated provisions; the Utah Commission on Aging; and the Alternative Dispute Resolution Act; removes the sunset date regarding lead acid battery disposal; extends the repeal date for the Rural Physician Loan Repayment Program Advisory Committee and provisions regarding the committee and program; makes technical changes regarding the State Weed Committee; and makes technical and conforming changes. Money Appropriated in this Bill: This bill appropriates $19,000 in operating and capital budgets for fiscal year 2027, all of which is from the General Fund. Other Special Clauses: This bill provides a special effective date. Section 4-17-104 is amended to read: 4-17-104 Effective 05/06/26 Repealed 07/01/26. Creation of State Weed Committee -- Membership -- Powers and duties -- Expenses. (1) There is created a State Weed Committee composed of eight members, with each member representing one of the following: (a) the Department of Agriculture and Food created in Section 4-2-102; (b) the Department of Natural Resources created in Section 79-2-201; (c) the Utah State University Agricultural Experiment Station; (d) the Utah State University Extension Service; (e) the Utah Association of Counties; (f) private a gricultural industry; (g) the Utah Weed Control Association; and (h) the Utah Weed Supervisors Association. (2) The commissioner shall select the members of the committee from those nominated by each of the respective groups or agencies described in Subsection (1) following approval by the executive committee of the Agricultural Advisory Board. (3) (a) Except as required by Subsection (3)(b), as terms of current committee members expire, the commissioner shall appoint each new member or reappointed member to a four-year term. (b) Notwithstanding the requirements of Subsection (3)(a), the commissioner shall, at the time of appointment or reappointment, adjust the length of terms to ensure that the terms of committee members are staggered so that approximately half of the committee is appointed every two years. (4) (a) Members may be removed by the commissioner for cause. (b) When a vacancy occurs in the membership for any reason, the replacement shall be appointed for the unexpired term. (5) The State Weed Committee shall: (a) confer and advise on matters pertaining to the planning, implementation, and administration of the state noxious weed program; (b) recommend [names] nominees to the commissioner for membership on the committee; and (c) serve as members of the executive committee of the Utah Weed Control Association. (6) A member may not receive compensation or benefits for the member's service, but may receive per diem and travel expenses in accordance with: (a) Section 63A-3-106; (b) Section 63A-3-107; and (c) rules made by the Division of Finance [pursuant to] under Sections 63A-3-106 and 63A-3-107. The following sums of money are appropriated for the fiscal year beginning July 1, 2026, and ending June 30, 2027. These are additions to amounts previously appropriated for fiscal year 2027. Subsection 12(a). Operating and Capital Budgets Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the Legislature appropriates the following sums of money from the funds or accounts indicated for the use and support of the government of the state of Utah. SOCIAL SERVICES DEPARTMENT OF HEALTH AND HUMAN SERVICES ITEM 1 Department of Health and Human Services - Clinical Services From General Fund 19,000 State Laboratory 19,000 The Legislature intends that the Department of Health and Human Services use the appropriations in this item to fund the Rare Disease Advisory Council described in Section 26B-1-402. Section 13. Effective Date. (1) Except as provided in Subsection (2), this bill takes effect May 6, 2026.
