1. Short title This Act may be cited as the Advancing Digital Support for Mental Health Services Act or the ADS for Mental Health Services Act .

2: Digital advertising platforms public service advertising reporting

This section would require a covered digital advertising platform to submit an annual report to the Federal Trade Commission. A covered digital advertising platform is a social media platform, search engine, or other public-facing website, online service, or application that sells digital advertising space and has more than 100,000,000 unique monthly users. The annual report must include: the number and percentage of the platform's total advertisements from the previous 12-month period that were public service advertisements; the estimated dollar value of those public service advertisements; the number of those advertisements that focus on local or regional mental, behavioral, and physical health care resources; the number of those advertisements that promote free mental, behavioral, or physical health care resources; and a description of how the advertisements meet the definition of a public service advertisement. Not later than 180 days after receiving the platforms' reports, and every year after that, the Federal Trade Commission would have to submit a publicly available report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives, summarizing the information the platforms reported. The Act defines a public service advertisement as one that meets all of the following: the platform displays it for free, without receiving any payment or other consideration in exchange; it promotes mental, behavioral, or physical health care resources, which may include advertisements that raise awareness of community events addressing social isolation, or advertisements that promote state, local, or regional mental health care resources approved by the Substance Abuse and Mental Health Services Administration that mitigate self-harm, suicide, eating disorders, substance abuse, and other matters posing a risk to physical and mental health, or that mitigate patterns of addiction-like behaviors, or that mitigate social isolation; and it is relevant and accessible to its targeted audience. Nothing in the Act would be read to override any privacy or data security laws that otherwise apply.

2. Digital advertising platforms public service advertising reporting (a) In general A covered digital advertising platform shall submit to the Commission an annual report that includes the following: (1) The number and percentage of total advertisements on the platform during the previous 12-month period that were public service advertisements. (2) The estimated dollar value of such public service advertisements. (3) The number of such public service advertisements that focus on local or regional mental, behavioral, and physical health care resources. (4) The number of such public service advertisements that promote free mental, behavioral, or physical health care resources. (5) A description of how such advertisements meet the definition of a public service advertisement as described in subsection (c)(3). (b) Report to Congress Not later than 180 days after receiving the reports required under subsection (a), and annually thereafter, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a publicly available report summarizing the information reported under such subsection. (c) Definitions In this Act: (1) Commission The term Commission means the Federal Trade Commission. (2) Public service advertisement The term public service advertisement means an advertisement that— (A) a covered digital advertising platform displays for free and without receiving any payment or other consideration in exchange; (B) promotes mental, behavioral, or physical health care resources, and may include advertisements that— (i) raise awareness of community events to address social isolation; or (ii) promote State, local, or regional mental health care resources that are approved by the Substance Abuse and Mental Health Services Administration that mitigate— (I) self-harm, suicide, eating disorders, substance abuse, and other matters that pose a risk to physical and mental health; (II) patterns of addiction-like behaviors; or (III) social isolation; and (C) is relevant and accessible to targeted audiences. (3) Covered digital advertising platform The term covered digital advertising platform means a social media platform, search engine, or other public-facing website, online service, or application that— (A) sells digital advertising space; and (B) has more than 100,000,000 unique monthly users. (d) Relationship to other laws Nothing in this Act shall be construed to supersede any applicable privacy or data security laws.
