Housing Unhoused Disabled Veterans Act

This section would give the Act the short title 'Housing Unhoused Disabled Veterans Act.'

This section would amend section 3(b)(4)(B) of the United States Housing Act of 1937 (42 U.S.C. 1437a(b)(4)(B)). It would renumber the current clauses (iv) and (v) of that provision as clauses (vi) and (vii), and insert two new clauses in their place. New clause (iv) would provide that, for the supported housing program under section 8(o)(19), any disability benefits a veteran receives under chapter 11 or chapter 15 of title 38, United States Code, would be excluded from income when determining eligibility for that program, except that the exclusion would not apply when calculating the veteran's adjusted income. New clause (v) would provide that, for a household receiving rental assistance under the supported housing program under section 8(o)(19), when that household's eligibility for other types of housing assistance is being determined, the same veteran disability benefits under chapter 11 or chapter 15 of title 38 would also be excluded from income for that other-program eligibility determination, except that this exclusion would likewise not apply when calculating adjusted income.

This section would require the Secretary of Housing and Urban Development to exclude a veteran's disability benefits received under chapter 11 or chapter 15 of title 38, United States Code, from income when determining whether that veteran may rent a residential dwelling unit built on Department property on or after the date this Act is enacted, if the rental assistance for that unit is provided through a housing assistance program administered by the Secretary of Housing and Urban Development that does not yet exist at the time this section is enacted. It defines 'Secretary' to mean the Secretary of Housing and Urban Development, and defines 'Department property' to have the same meaning given that term in section 901 of title 38, United States Code.
