1. Short title This Act may be cited as the Protecting Human Rights and Public Health in Foreign Assistance Act .

2: Nullifying certain rules relating to foreign assistance

This section would say that three named final rules issued by the Department of State, and any successor or substantially similar rules, have no force or effect. No federal department or agency could take any action to implement, administer, or enforce those three final rules, or to propose, finalize, implement, administer, or enforce any successor or substantially similar rules or policies to them. The three final rules would be treated as though they had never taken effect. The three final rules covered are: the Department of State's final rule on "Protecting Life in Foreign Assistance" (91 Fed. Reg. 3319, dated January 27, 2026); the Department of State's final rule on "Combating Discriminatory Equity Ideology in Foreign Assistance Rules" (91 Fed. Reg. 3345, dated January 27, 2026); and the Department of State's final rule on "Combating Gender Ideology in Foreign Assistance" (91 Fed. Reg. 3332, dated January 27, 2026).

2. Nullifying certain rules relating to foreign assistance (a) In general (1) No force or effect The final rules described in subsection (b) and any successor or substantially similar rules shall have no force or effect. (2) Prohibition No Federal department or agency may take any action— (A) to implement, administer, or enforce the final rules described in subsection (b); or (B) to propose, finalize, implement, administer, or enforce any successor or substantially similar rules or policies to the final rules described in subsection (b). (3) Retroactivity The final rules described in subsection (b) shall be treated as though they had never taken effect. (b) Final rules described The final rules described in this subsection are— (1) the final rule submitted by the Department of State relating to Protecting Life in Foreign Assistance (91 Fed. Reg. 3319; January 27, 2026). (2) the final rule submitted by the Department of State relating to Combating Discriminatory Equity Ideology in Foreign Assistance Rules (91 Fed. Reg. 3345; January 27, 2026). (3) the final rule submitted by the Department of State relating to Combating Gender Ideology in Foreign Assistance (91 Fed. Reg. 3332; January 27, 2026).
