1. Short title This Act may be cited as the No Funds for Repeat Child Care Violations Act .
2: Strengthening the authority to withhold funds for fraud
This section would amend Section 658I(b)(2)(B) of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858g(b)(2)) by changing the word 'may' to 'shall.' Under current law, the Secretary of Health and Human Services has discretion over whether to withhold Child Care and Development Block Grant funds from a State in the fraud-related circumstance covered by that subsection. This section would remove that discretion, requiring the Secretary to withhold the funds rather than leaving the decision optional.
