3: Improvements to certification process

This section would amend section 102(1) of the Terrorism Risk Insurance Act of 2002. Section 102(1) contains, in subparagraph (B), a list of conditions that bar the Secretary from certifying an act as an act of terrorism. In subparagraph (B), the section would change a dollar figure in that list from $5,000,000 to $25,000,000. It would also add a new condition to the list: that the Secretary did not certify the act as an act of terrorism before the 90-day period following publication of a Federal Register notice, described below, ran out. The section would also strike subparagraph (D) entirely and put new notice requirements in its place. Under the new requirements, the Secretary would have to publish a notice in the Federal Register no later than 30 days after starting the process of deciding whether to certify an act as an act of terrorism, telling the public that the determination process is underway. The Secretary could also publish an additional notice, in the Federal Register or through another method, stating that a particular act is not being evaluated for certification.
