1: Authorization for award of Medal of Honor to James Capers, Jr., for acts of valor as a member of the Marine Corps during the Vietnam War

This section would authorize the President to award the Medal of Honor to James Capers, Jr., under section 8291 of title 10 of the United States Code, for acts of valor described in the section. This authorization would apply despite the time limitations in sections 8298(a) and 8300 of title 10, and despite any other time limitation that would otherwise apply to awarding certain medals to people who served in the Armed Forces, so the President could make the award even though those time limits would otherwise stand in the way. The acts of valor for which the medal would be awarded are the actions James Capers, Jr., took as a member of the Marine Corps from March 31 through April 3, 1967, during the Vietnam War, the same actions for which he had previously been awarded the Silver Star.
