1. Short title This Act may be cited as the Noncontiguous Energy Relief and Access Act of 2025 .

2: Energy products exemption

This section would amend section 55102 of title 46, United States Code. It would rewrite subsection (a) to define six terms. "Covered noncontiguous trade" would mean trade between one of the 48 contiguous states and Alaska, Hawaii, Guam, or the Commonwealth of Puerto Rico, and also trade between a place in Alaska, Hawaii, Guam, or Puerto Rico and another place in Alaska, Hawaii, Guam, or Puerto Rico. "Energy products" would mean any equipment, component of equipment, or energy source used to generate, store, transmit, or distribute electricity. "Energy source" would mean liquefied natural gas or any other energy source needed to generate electricity, and a petroleum product. "Equipment" would mean power generators, storage units, wind turbines, solar panels, hydroelectric plants, and any other components needed to generate, transmit, or distribute electricity. "Merchandise" would include merchandise owned by the United States government, a state, or a subdivision of a state, and valueless material. "Petroleum product" would have the meaning given that term in section 3 of the Energy Policy and Conservation Act (42 U.S.C. 6202). The section would also renumber the current subsection (c) of section 55102 as subsection (d), without changing its content, and would add a new subsection (c) stating that subsection (b) of section 55102 would not apply to the transportation of energy products in covered noncontiguous trade on a vessel.
