1: Servicemembers Civil Relief Act: preemption of squatters' rights
This section would add a new section 301A to the Servicemembers Civil Relief Act. Under the new section, a state law that gives someone squatter's rights would not apply to a property if two conditions are both true: the property is owned by a servicemember, and a squatter occupied the property during a period when that servicemember was on military service. This section would also add a matching entry to the Act's table of contents for the new section 301A.

1. Servicemembers Civil Relief Act: preemption of squatters’ rights (a) Preemption The Servicemembers Civil Relief Act (54 Stat. 1178; 50 U.S.C. 3901 et seq. ) is amended by inserting, after section 301, the following new section: 301A. Preemption of squatter’s rights Any State law establishing squatter’s rights shall not apply to premises— (1) owned by a servicemember; and (2) occupied by a squatter during a period of military service of such servicemember. . (b) Clerical amendment The table of contents in section 1(b) of such Act ( 50 U.S.C. 3901(b) ) is amended by inserting after the item relating to section 301 the following new item: 301A. Preemption of squatter’s rights. .
