2Banning of products containing a high concentration of sodium nitrite
This section would make any consumer product containing a high concentration of sodium nitrite a banned hazardous product under section 8 of the Consumer Product Safety Act. The ban would not apply to any commercial or industrial use in which high-concentration sodium nitrite is not customarily produced or distributed for sale to, or for use, consumption, or enjoyment by, a consumer. The ban would also not apply to high-concentration sodium nitrite that meets the legal definition of a drug, device, or cosmetic, or of food, under the Federal Food, Drug, and Cosmetic Act, including poultry and poultry products under the Poultry Products Inspection Act, meat and meat food products under the Federal Meat Inspection Act, and eggs and egg products under the Egg Products Inspection Act. For this section, 'consumer product' has the meaning already given that term in the Consumer Product Safety Act, and 'high concentration of sodium nitrite' means a concentration of 10 percent or more by weight of sodium nitrite. This section would take effect 90 days after the date the Act becomes law.
