H.B. No. 2885 AN ACT relating to allowing the governing bodies of certain political subdivisions to call for a local option election relating to the sale of alcoholic beverages. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 501, Election Code, is amended by adding Section 501.0211 to read as follows: Sec. 501.0211. ELECTION CALLED BY GOVERNING BODY OF POLITICAL SUBDIVISION. (a) This section applies only to: (1) a county: (A) with a population of more than 70,000 and less than 100,000; (B) that contains a portion of the Colorado River; and (C) that is adjacent to a county with a population of one million or more; and (2) a municipality: (A) with a population of 240,000 or more; (B) that is located in two or more counties; and (C) that borders a man-made lake that has a surface area of at least 20,000 acres. (b) The commissioners court of a county may, on the commissioners court's own motion, order a local option election to be held in the county or a justice precinct in the county to determine whether the sale of alcoholic beverages of one or more of the various types and alcoholic contents shall be legalized in the county or the justice precinct. (c) The governing body of a municipality located in a county described by Subsection (a)(1) may, by resolution, order a local option election to be held in the municipality to determine whether the sale of alcoholic beverages of one or more of the various types and alcoholic contents shall be legalized in the municipality. (d) The governing body of a municipality described by Subsection (a)(2) may, by resolution, order a local option election to be held in the municipality to determine whether the sale of mixed beverages, as described by Section 501.035(b)(8), shall be legalized in the municipality.
