AN ACT to amend Tennessee Code Annotated, Title 5 and Title 12, Chapter 3, Part 12, relative to
          county governments.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Title 5, Chapter 1, is amended by adding the
following as a new part:

          5-1-401. Definitions.

                    As used in this part:

                              (1) "County legislative body" means that body vested by either the county
charter or general law with the legislative powers of the county government; and

                              (2) "Self-insures" means a county that provides health insurance for its
employees and pays the associated medical care cost directly to the provider or
through a third-party administrator directly to the provider.

5-1-402. Authority for counties that self-insure.

Notwithstanding another law to the contrary, a county legislative body may require a
competitive bid process for insurance brokerage services if the county self-insures and has
adopted the County Purchasing Law of 1957, compiled in chapter 14, part 1 of this title.

SECTION 2. The headings in this act are for reference purposes only and do not constitute a
part of the law enacted by this act. However, the Tennessee Code Commission is requested to include
the headings in any compilation or publication containing this act.

SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
