S2854 2026 -- S 2854 ======== LC005524 ======== STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2026 ____________ A N A C T RELATING TO STATE AFFAIRS AND GOVERNMENT -- DEPARTMENT OF HUMAN SERVICES Introduced By: Senators Thompson, Murray, and Famiglietti Date Introduced: March 04, 2026 Referred To: Senate Health & Human Services It is enacted by the General Assembly as follows: 1 SECTION 1. Section 42-12-20 of the General Laws in Chapter 42-12 entitled Department 2 of Human Services is hereby amended to read as follows: 3 42-12-20. Responsibility of director — Traumatic brain injury. 4 It shall be the responsibility of the director of the department of human services secretary 5 of the executive office of health and human services (EOHHS) to provide rehabilitative services 6 for persons with traumatic brain injury including the development of instate comprehensive 7 community-based services. 8 The department of human services executive office of health and human services 9 (EOHHS) , in consultation with the permanent advisory commission on traumatic brain injuries, 10 shall promulgate such rules and regulations in accordance with the Administrative Procedures Act, 11 chapter 35 of this title, as are necessary and proper to ensure responsible management and operation 12 of § 42-12-30. 13 SECTION 2. This act shall take effect upon passage. ======== LC005524 ======== EXPLANATION BY THE LEGISLATIVE COUNCIL OF A N A C T RELATING TO STATE AFFAIRS AND GOVERNMENT -- DEPARTMENT OF HUMAN SERVICES *** 1 This act would transfer responsibility for implementation of services for persons with 2 traumatic brain injuries from the director of the department of human services to the EOHHS. 3 This act would take effect upon passage. ======== LC005524 ======== LC005524 - Page 2 of 2
