H8558 2026 -- H 8558 ======== LC006472 ======== STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2026 ____________ A N A C T RELATING TO TOWNS AND CITIES -- GENERAL POWERS -- CITY OF WARWICK Introduced By: Representatives McNamara, Solomon, Bennett, Hopkins, and Shanley Date Introduced: May 15, 2026 Referred To: House Municipal Government & Housing It is enacted by the General Assembly as follows: 1 SECTION 1. Section 45-2-6 of the General Laws in Chapter 45-2 entitled General 2 Powers is hereby amended to read as follows: 3 45-2-6. Lands given for specific use not subject to disposal. 4 (a) Except as provided in subsection (b) of this section, nothing Nothing in § 45-2-5 shall 5 be construed to authorize the sale, lease, or conveyance of lands or improvements acquired by gift 6 or devise for the public use, whether or not the gift or devise is subject to a condition subsequent 7 or reverter; and no property held by any city or town as part of a charitable trust shall be considered 8 to come within the provisions of § 45-2-5. 9 (b) Notwithstanding subsection (a) of this section, the city of Warwick may sell, convey, 10 or grant, for consideration or otherwise, the parcel of real estate located at 34 Warwick Lake 11 Avenue, identified on the Warwick tax assessor s maps as Plat 328, Lot 261, in fee simple absolute 12 or otherwise, pursuant to the procedures set forth in § 45-5-5, all restrictions of record having 13 already expired pursuant to § 34-4-24. 14 SECTION 2. This act shall take effect upon passage. ======== LC006472 ======== EXPLANATION BY THE LEGISLATIVE COUNCIL OF A N A C T RELATING TO TOWNS AND CITIES -- GENERAL POWERS -- CITY OF WARWICK *** 1 This act would grant the city of Warwick the authority to sell the property located at 34 2 Warwick Lake Avenue, without regard for statutory limitations pursuant to § 45-2-6, to clear the 3 title to said property. 4 This act would take effect upon passage. ======== LC006472 ======== LC006472 - Page 2 of 2
