H7409 2026 -- H 7409 ======== LC004686 ======== STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2026 ____________ A N A C T RELATING TO COMMERCIAL LAW -- GENERAL REGULATORY PROVISIONS -- DECEPTIVE TRADE PRACTICES Introduced By: Representatives Bennett, Edwards, McNamara, Kazarian, Corvese, Hull, Noret, Shanley, Read, and Slater Date Introduced: January 30, 2026 Referred To: House Corporations It is enacted by the General Assembly as follows: 1 SECTION 1. Chapter 6-13.1 of the General Laws entitled Deceptive Trade Practices is 2 hereby amended by adding thereto the following section: 3 6-13.1-31. Credit card surcharge prohibited. 4 It shall be a deceptive trade practice in violation of this chapter for any retail establishment 5 offering goods or services for sale to impose a surcharge fee on a customer who uses a credit card 6 for a transaction occurring in the state. 7 SECTION 2. This act shall take effect upon passage. ======== LC004686 ======== EXPLANATION BY THE LEGISLATIVE COUNCIL OF A N A C T RELATING TO COMMERCIAL LAW -- GENERAL REGULATORY PROVISIONS -- DECEPTIVE TRADE PRACTICES *** 1 This act would prohibit a seller from imposing a surcharge fee on a customer who uses a 2 credit card for a transaction occurring in the state. 3 This act would take effect upon passage. ======== LC004686 ======== LC004686 - Page 2 of 2
