H7235 2026 -- H 7235 ======== LC004035 ======== STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2026 ____________ A N A C T RELATING TO STATE AFFAIRS AND GOVERNMENT -- RHODE ISLAND COMMERCE CORPORATION Introduced By: Representatives Kennedy, Shanley, Cotter, Fellela, Serpa, Diaz, Ackerman, Edwards, Azzinaro, and O Brien Date Introduced: January 21, 2026 Referred To: House State Government & Elections It is enacted by the General Assembly as follows: 1 SECTION 1. Section 42-64-14.1 of the General Laws in Chapter 42-64 entitled Rhode 2 Island Commerce Corporation is hereby amended to read as follows: 3 42-64-14.1. Exclusive jurisdiction of general assembly to approve or deny oil refinery 4 or nuclear plant project plans Exclusive jurisdiction of general assembly to approve or deny 5 oil refinery project plans. 6 The final approval or denial of a project plan for the location and construction of an oil 7 refinery or a nuclear plant within the state is hereby expressly reserved to the general assembly 8 notwithstanding any general or public law or ordinance to the contrary, and exclusively within the 9 jurisdiction of the general assembly. The exclusive jurisdiction is vested in the general assembly 10 notwithstanding any other general, special, or public law to the contrary, including, but not limited 11 to, those laws granting regulatory powers to the cities and towns, and any ordinances enacted 12 pursuant to these laws. 13 SECTION 2. This act shall take effect upon passage. ======== LC004035 ======== EXPLANATION BY THE LEGISLATIVE COUNCIL OF A N A C T RELATING TO STATE AFFAIRS AND GOVERNMENT -- RHODE ISLAND COMMERCE CORPORATION *** 1 This act would remove nuclear plant projects from seeking the approval from the general 2 assembly for the construction of said nuclear plant. 3 This act would take effect upon passage. ======== LC004035 ======== LC004035 - Page 2 of 2
