7 An Act relating to eminent domain; amending 27 O.S.
7 2021, Section 7, which relates to eminent domain for
8 light, heat, or power by electricity or gas;
8 prohibiting use of eminent domain for certain energy
9 projects and facilities; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 27 O.S. 2021, Section 7, is
13
14 amended to read as follows:

15 Section 7. A. Except as otherwise provided in this section,
15
16 any person, firm, or corporation organized under the laws of this
16
17 state, or authorized to do business in this state, to furnish light,
17
18 heat, or power by electricity or natural gas, or any other person,
18
19 association, or firm engaged in furnishing lights, heat, or power by
19
20 electricity or natural gas shall have and exercise the right of
20
21 eminent domain in the same manner and by like proceedings as
21
22 provided for railroad corporations by laws of this state.

23 B. The power of eminent domain shall not be used for the siting
23
24 or building of wind turbines energy facilities, solar energy

1 facilities, battery storage facilities, hydrogen gas facilities, or
1
2 carbon capture and sequestration projects on private property.

3 SECTION 2. It being immediately necessary for the preservation
3
4 of the public peace, health or safety, an emergency is hereby
4
5 declared to exist, by reason whereof this act shall take effect and
5
6 be in full force from and after its passage and approval.
