7 An Act relating to real property; prohibiting leasing
7 or owning of real property by certain persons;
8 providing exception; requiring certain affidavit as
8 an attachment to lease or deed; requiring
9 promulgation of certain form by Attorney General;
9 requiring reversion of leased land under certain
10 circumstances; requiring sale of owned land under
10 certain circumstances; directing Attorney General to
11 take certain actions; providing for codification; and
11 providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 128 of Title 60, unless there is
16
17 created a duplication in numbering, reads as follows:
17
18 A. No alien or any person who is not a citizen of the United
18
19 States shall own or lease real property in this state either
19
20 directly or indirectly through a business entity or trust.
20
21 Provided, however, the requirements of this subsection shall not
21
22 apply to a business entity that is engaged in regulated interstate
22
23 commerce in accordance with federal law.

1 B. On or after the effective date of this act, any deed or
1
2 lease for real property shall include as an exhibit an affidavit
2
3 executed by the person or entity leasing the land attesting that the
3
4 person, business entity, or trust is purchasing or leasing the land
4
5 in compliance with the requirements of this section and that no
5
6 funding source is being used in violation of this section or any
6
7 other state or federal law. The Attorney General shall promulgate a
7
8 separate affidavit form for individuals and for business entities or
8
9 trusts to comply with the requirements of this section, with the
9
10 exception of those leases which the Attorney General deems necessary
10
11 when promulgating the affidavit form.

12 C. From the effective date of this act, any lease found to be
12
13 in violation of this section shall not be eligible for renewal and
13
14 all rights to the leased real property shall immediately revert back
14
15 to the lessor at the expiration of the lease.

16 D. From the effective date of this act, any alien or person who
16
17 is not a citizen of the United States who owns real property in this
17
18 state shall have six (6) months to divest his or her ownership in
18
19 the real property.

20 E. If after the expiration of six (6) months from the effective
20
21 date of this act any alien or person who is not a citizen of the
21
22 United States continues to own real property in this state, the
22
23 Attorney General shall be authorized to bring an action in district
23
24 court to enforce the provisions of this act.

1 SECTION 2. This act shall become effective November 1, 2025.
