7   An Act relating to public display of lewd acts;

7   defining terms; prohibiting lewd acts or obscene

8   material in public place; prohibiting certain actions

8   in public place; creating felony offense for

9   intentional display of lewd acts or obscene material

9   to minor; authorizing certain cause of action;

10  providing for codification; and providing an

10  effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.     NEW LAW  A new section of law to be codified

14

15 in the Oklahoma Statutes as Section 1024.6 of Title 21, unless there
15

16 is created a duplication in numbering, reads as follows:

17  A. For the purposes of this act:

17

18  1. "Lewd acts" means any sexual behavior imitating sex or

18

19 sexual acts, groping, indecent exposure of genitalia or sexual
19

20 paraphernalia, display of replicas of genitalia, sexually touching
20

21 oneself or someone else, or convincing or forcing someone else to
21

22 sexually touch or observe sexual behavior; and

23  2. "Obscene material" shall have the meaning as provided in

23

24 subsection B of Section 1024.1 of Title 21 of the Oklahoma Statutes.

1   B. No political subdivision of this state shall allow or permit

2 a public display of lewd acts or obscene material in a public place
2

3 including, but not limited to, parades, shows, concerts, plays, or
3

4 any other activity where a minor could witness such lewd acts or
4

5 obscene material. No individual shall be allowed to show lewd acts
5

6 or obscene material in a public place where any other individual
6

7 could witness such lewd acts or obscene material. A political
7

8 subdivision acting in good faith in accordance with the requirements
8

9 of this subsection shall not be liable for acts of an individual or
9

10 group in violation of this section.

11  C. Any individual intentionally displaying lewd acts or obscene

11

12 material in front of a minor shall be guilty of a felony. Any
12

13 person may have a cause of action against such individual who
13

14 intentionally commits such acts in any manner in which a minor was
14

15 exposed to the lewd act or obscene material, or an individual was
15

16 unwillingly exposed to the lewd act or obscene material.

17  SECTION 2. This act shall become effective November 1, 2025.
