7 An Act relating to county officers; allowing for
7 certain counties to employ a county manager;
8 designating duties of county manager; amending 19
8 O.S. 2021, Section 1407, which relates to the
9 membership of county budget boards; providing for
9 certain ex officio member of county budget board;
10 making language gender neutral; providing for
10 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 491 of Title 19, unless there is
15
16 created a duplication in numbering, reads as follows:

17 The board of county commissioners of a county with a population
17
18 greater than five hundred thousand (500,000) according to the latest
18
19 Federal Decennial Census, with the approval of the county budget
19
20 board, may, by resolution, employ and set the salary of a county
20
21 manager. Such county manager shall:
21
22 1. Work with the board of county commissioners, other county
22
23 officers, and county employees to improve the efficiency of county
23
24 government operations;

1 2. Oversee a county human resources department;

2 3. Assist the board of county commissioners and county budget
2
3 board with developing and implementing the county budget;
3
4 4. Oversee a county information technology department;
4
5 5. Serve as an ex officio member of the county budget board;

6 and
6
7 6. Perform other administrative functions delegated to the
7
8 county manager by the board of county commissioners or the county
8
9 budget board.

10 SECTION 2. AMENDATORY 19 O.S. 2021, Section 1407, is
10
11 amended to read as follows:
11
12 Section 1407. A county budget board is created in each county
12
13 which elects to come under the provisions of this act the County
13
14 Budget Act. The board shall consist of each elected county officer.
14
15 If the county has a county manager, as provided for in Section 1 of
15
16 this act, the county manager shall serve as an ex officio member of
16
17 the county budget board. The chairman chair of the board of county
17
18 commissioners shall serve as chairman chair of the county budget
18
19 board. The county clerk shall serve as secretary of the county
19
20 budget board. The chairman chair shall have all the rights and
20
21 privileges as of any other member of the board, including the right
21
22 to vote on questions. Each member of the board shall be entitled to
22
23 cast one vote. The members shall elect a vice-chairman vice chair
23
24 from among them and develop such other rules or procedures as may be

1 necessary to ensure the orderly conduct of business. The vice-
1
2 chairman vice chair shall serve as chairman chair during the absence
2
3 or vacancy of the chairman chair. When a vacancy occurs in the
3
4 office of any county officer serving as a member of the board, such
4
5 position on the board shall be considered vacant until the county
5
6 office is filled in the manner provided by law. Regular meetings of
6
7 the board shall be set by the board. Special meetings shall be held
7
8 at the call of the chairman chair or any two (2) members of the
8
9 board. A majority of all the members of the board then in office
9
10 shall constitute a quorum and have the power to transact business.
10
11 Any official action of the board in adopting or revising the county
11
12 budget or any portion thereof shall be effective upon the approving
12
13 vote of a majority of all the board members then in office.

14 SECTION 3. This act shall become effective November 1, 2025.
