7   An Act relating to juries; amending 21 O.S. 2021,

7   Section 385, which relates to juror misconduct;

8   increasing certain violations to a felony; and

8   providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY   21 O.S. 2021, Section 385, is

13

14 amended to read as follows:
14

15  A. Every juror or person drawn or summoned as a juror, or

15

16 chosen arbitrator, or umpire, or appointed referee, who either:
16

17  1. Makes any promise or agreement to give a verdict for or

17

18 against any party; or,
18

19  2. Willfully permits any communication to be made to him, or

19

20 receives any book, paper, instrument, or information relative to any
20

21 cause pending before him, except according to the regular course of
21

22 proceeding upon the trial of such cause, is guilty of a misdemeanor.

23  B. Subsequent violations or egregious violations of subsection

23

24 A of this section may be charged as a felony.
