7 An Act relating to legislative testimony; amending 62
7 O.S. 2021, Section 34.96, which relates to the
8 Legislative Oversight Committee on State Budget
8 Performance; requiring administration of oath to
9 persons providing testimony before legislative
9 committees; creating misdemeanor offense for certain
10 acts; updating statutory language; and declaring an
10 emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 62 O.S. 2021, Section 34.96, is
14
15 amended to read as follows:
15
16 Section 34.96. A. There is hereby established the Legislative
16
17 Oversight Committee on State Budget Performance. The purposes of
17
18 this committee shall include oversight of the implementation of a
18
19 system of program performance-based budgeting for implementation by
19
20 state agencies.
20
21 B. The Committee's duties shall also include:
21
22 1. Development of agency budget request forms and instructions
22
23 in conjunction with the Office of Management and Enterprise
23
24 Services;

1 2. Directing studies to aid in the development of legislative

2 and procedural changes to further improve the budgetary, financial,
2
3 accounting, reporting, personnel, and purchasing processes and
3
4 systems of the state;

5 3. Direction of program evaluation and management studies;
5
6 4. Oversight and reporting on executive branch compliance with
6
7 the legislative intent of appropriation measures. Such oversight
7
8 and reporting duties may include:

9 a. agency reorganization actions,
9
10 b. executive orders calling for reduction of full-time-
10
11 equivalents or hiring freezes, and
11
12 c. transfer of funds by the executive branch;
12
13 5. The development of revenue and expenditure estimates and
13
14 analyses;
14
15 6. Study of the management, operations, programs and fiscal
15
16 needs of the agencies and institutions of Oklahoma state government
16
17 pursuant to the Oklahoma Program Performance Budgeting and
17
18 Accountability Act;
18
19 7. Review of the executive budget, agency strategic plans and
19
20 the estimate of needs of each state agency and institution. Reports
20
21 may be issued by the Committee as it deems appropriate; and
21
22 8. Implementation of an ongoing evaluation review procedure of
22
23 existing programs based on performance-informed budgeting techniques
23
24 pursuant to the Oklahoma Program Performance Budgeting and

1 Accountability Act. The committee Committee in cooperation with the
1
2 Office of Management and Enterprise Services shall establish a
2
3 schedule to review strategic plans and existing programs for each
3
4 agency a minimum of once every four (4) years. The committee
4
5 Committee shall issue an evaluation report for each agency once
5
6 every four (4) years which will include, but not be limited to, the
6
7 following information:
7
8 a. a review of the agency's programs, performance and
8
9 management,
9
10 b. whether the agency has demonstrated that there is a
10
11 need for the services and programs which justifies the
11
12 agency's continued existence, and
12
13 c. whether the agency is the most appropriate provider of
13
14 the programs and services furnished by the agency.
14
15 C. Any reference in the Oklahoma Statutes to the Joint
15
16 Legislative Committee on Budget and Program Oversight shall be a
16
17 reference to the Legislative Oversight Committee on State Budget
17
18 Performance.
18
19 D. The Committee shall be composed of three members appointed
19
20 by the President Pro Tempore of the Senate, three members appointed
20
21 by the Speaker of the House of Representatives, two members by the
21
22 minority leader Minority Leader of the Senate and two members
22
23 appointed by the minority leader Minority Leader of the House of
23
24 Representatives. The Chair chair and Vice Chair vice chair of the

1 Committee shall rotate every two (2) years between the Senate and
1
2 the House of Representatives beginning with a Senate member serving
2
3 as Chair chair in 2003. The Committee shall meet at least four (4)
3
4 times per year and at other times as called by the Chair chair. The
4
5 Legislative Oversight Committee on State Budget Performance shall
5
6 function as a committee of the Legislature when the Legislature is
6
7 in session and is not in session. Each member of the Committee
7
8 shall serve until a successor is appointed. The duties of the
8
9 Committee may be performed by the Appropriations Committee of the
9
10 Senate and the Appropriations and Budget Committee of the House of
10
11 Representatives or subcommittees thereof.

12 E. The Committee shall be staffed jointly by the staff of the
12
13 fiscal divisions of the Senate and the House of Representatives.
13
14 F. The Committee may make use of all available teleconferencing
14
15 technology to facilitate meetings of the Committee when the
15
16 Legislature is not in session. The Committee shall take any
16
17 appropriate action to make such teleconferenced meetings comply with
17
18 the provisions of the Oklahoma Open Meeting Act, Section 301 et seq.
18
19 of Title 25 of the Oklahoma Statutes.
19
20 G. The Committee shall periodically meet in different
20
21 geographical regions of the state to enhance the Committee's
21
22 understanding of local conditions and to help educate the public as
22
23 to the fiscal condition of the state.

1 H. 1. Any person offering testimony before the Legislative
1
2 Oversight Committee on State Budget Performance, the Appropriations
2
3 Committee of the Senate or the Appropriations and Budget Committee
3
4 of the House of Representatives, any subcommittee thereof, or any
4
5 policy committee of the Legislature shall have an oath administered
5
6 that he or she will testify truly, or that any written testimony
6
7 provided is true or believed to be true.
7
8 2. A person shall be guilty of a misdemeanor if the person
8
9 violates the oath required in paragraph 1 of this subsection by
9
10 knowingly and willfully:
10
11 a. falsifying or concealing any material fact,
11
12 b. making any materially false, fictitious, or fraudulent
12
13 statement or representation, or
13
14 c. presenting any false writing or document.
14
15 SECTION 2. It being immediately necessary for the preservation
15
16 of the public peace, health or safety, an emergency is hereby
16
17 declared to exist, by reason whereof this act shall take effect and
17
18 be in full force from and after its passage and approval.
