7 An Act relating to elections; amending 26 O.S. 2021,
7 Section 3-123, which relates to polling places;
8 requiring school board to provide rooms as polling
8 places; amending 26 O.S. 2021, Section 14-115.1, as
9 last amended by Section 21, Chapter 452, O.S.L. 2024
9 (26 O.S. Supp. 2024, Section 14-115.1), which relates
10 to incapacitated voter unable to vote in person;
10 adding persons eligible to provide certain statement;
11 and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 26 O.S. 2021, Section 3-123, is
15
16 amended to read as follows:
16
17 Section 3-123. The board of education of any school district
17
18 may shall, and the governing board of any municipality shall,
18
19 furnish a room or rooms in any school building or municipal building
19
20 for use as a polling place at no cost.
20
21 SECTION 2. AMENDATORY 26 O.S. 2021, Section 14-115.1, as
21
22 last amended by Section 21, Chapter 452, O.S.L. 2024 (26 O.S. Supp.
22
23 2024, Section 14-115.1), is amended to read as follows:

1 Section 14-115.1. A. A registered voter who becomes physically
1
2 incapacitated after the deadline to request an absentee ballot as
2
3 provided in Section 14-103 of this title and is unable to vote in
3
4 person at the appropriate precinct on the day of the election may
4
5 make a written request for an absentee ballot. Requirements for
5
6 matching of name, birth date, and identification number established
6
7 pursuant to Section 14-105 of this title shall apply to a request
7
8 for absentee ballots under this section.
8
9 B. 1. The request shall be signed by the voter or signed by a
9
10 witness at the voter's direction if the voter is unable to sign his
10
11 or her name, and shall be transmitted to the secretary of the county
11
12 election board.
12
13 2. The person transmitting the request on behalf of the voter
13
14 may be anyone of the voter's choosing who is at least sixteen (16)
14
15 years of age; provided, the person is not employed by nor related
15
16 within the third degree of consanguinity or affinity to any person
16
17 whose name appears on the ballot.
17
18 3. The person becomes the voter's agent for purposes of voting
18
19 by absentee ballot. The voter's request must be accompanied by a
19
20 sworn statement by a duly licensed physician, physician assistant,
20
21 nurse practitioner, or licensed midwife. Expected or likely
21
22 confinement for childbirth on election day is sufficient cause to
22
23 entitle a voter to vote absentee pursuant to this section. The
23
24 physician's statement must attest to the fact that the voter is in

1 fact unable to vote in person at the appropriate precinct on the day

2 of the election because of a physical incapacity and that the
2
3 physical incapacity originated after the deadline to request an
3
4 absentee ballot as provided in Section 14-103 of this title.

5 4. Upon receipt of the voter's request and accompanying sworn
5
6 statement, the secretary of the county election board shall issue to
6
7 the voter's agent the appropriate ballots and envelopes required for
7
8 voting by incapacitated voters.
8
9 5. The ballots must be returned by the agent to the secretary
9
10 of the county election board no later than 7:00 p.m. on the day of
10
11 the election. No person may be the agent for more than one voter at
11
12 any election. Upon return of the absentee ballots, the secretary of
12
13 the county election board shall cause the ballots to be processed in
13
14 the same manner as is prescribed for other absentee ballots.

15 SECTION 3. This act shall become effective November 1, 2025.
