7 An Act relating to health care facilities; defining
7 terms; requiring certain facilities to adopt and
8 implement certain policy related to surgical smoke;
8 providing for codification; and providing an
9 effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 1-708a of Title 63, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. As used in this section:

16 1. "Surgical smoke" means the gaseous by-product, including
16
17 surgical plume, smoke plume, bio-aerosols, laser-generated airborne
17
18 contaminants, and lung-damaging dust, produced by an energy-
18
19 generating device used in a room in which a surgical procedure is
19
20 performed; and

21 2. "Surgical smoke evacuation system" means equipment designed
21
22 to capture and neutralize surgical smoke at the site of origin and
22
23 before the surgical smoke makes contact with the eyes or respiratory

1 tract of any individual occupying a room in which a surgical

2 procedure is performed.

3 B. A hospital or ambulatory surgical center licensed by the
3
4 State Department of Health shall adopt and implement a policy to
4
5 prevent an individual's exposure to surgical smoke through the use
5
6 of a surgical smoke evacuation system during each planned surgical
6
7 procedure that is likely to generate surgical smoke.

8 SECTION 2. This act shall become effective November 1, 2025.
