7 An Act relating to social media; defining terms;
7 requiring certain age verification; requiring
8 segregation of certain data; requiring social media
8 platforms to take certain actions for minor users;
9 providing certain criteria; requiring social media
9 platforms to offer certain supervisory tools;
10 prohibiting certain action; requiring certain
10 parental consent; stating certain presumption;
11 stating certain exceptions; authorizing certain
11 appeal; establishing time frame for certain
12 determination; construing provision; authorizing
12 Attorney General to bring civil action and seek
13 certain relief; providing for codification; and
13 providing an effective date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16
17 SECTION 1. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 204 of Title 75A, unless there
18
19 is created a duplication in numbering, reads as follows:
19
20 A. As used in this section:
20
21 1. "Account" means a digital profile on a social media platform
21
22 that is created by a user;
22
23 2. "Connected account" means an account on the social media
23
24 platform that is directly connected to:

1 a. the minor user's account, or
1
2 b. an account that is directly connected to an account
2
3 directly connected to the minor's account;
3
4 3. "Content" means any information, visual depictions, tools,
4
5 features, links, software, or other materials that appear on or are
5
6 available or enabled through a social media platform;
6
7 4. "Directly connected" means an account on the social media
7
8 platform that is connected to another account by:
8
9 a. sending a request to connect to another account holder
9
10 and having the request to connect accepted by the
10
11 other account holder, or
11
12 b. receiving a request to connect from another account
12
13 holder and accepting the request to connect;
13
14 5. "Minor" means an individual under eighteen (18) years of
14
15 age;
15
16 6. "Personal information" means information that is linked or
16
17 can be reasonably linked to an individual, including, but not
17
18 limited to:
18
19 a. first and last name,
19
20 b. date of birth,
20
21 c. home or physical address, including street name and
21
22 city,
22
23 d. screen name or username that reveals an individual's
23
24 email address, first name, or last name,

1 e. telephone number,

2 f. Social Security number,

3 g. photograph, video, or audio file containing a person's
3
4 image or voice,
4
5 h. geolocation information sufficient to identify street
5
6 name and city, and
6
7 i. any other identifier that a person may use to contact
7
8 a specific individual;
8
9 7. "Push notification" means an automatic electronic message
9
10 displayed on an account holder's device, when the user interface for
10
11 the social media service is not actively open or visible on the
11
12 device, that prompts the account holder to check or engage with the
12
13 social media platform;
13
14 8. "Social media platform" means a website or internet medium
14
15 that:
15
16 a. permits a person to become a registered user,
16
17 establish an account, or create a profile for the
17
18 purpose of allowing users to create, share, and view
18
19 user-generated content through such an account or
19
20 profile,
20
21 b. enables one or more users to generate content that can
21
22 be viewed by other users of the medium, and
22

1 c. primarily serves as a medium for users to interact

2 with content generated by other users of the medium;
2
3 and
3
4 9. "User" means an individual who accesses or uses a social
4
5 media platform.

6 B. 1. A social media platform shall perform reasonable age
6
7 verification methods to determine whether a user who is a resident
7
8 of this state is a minor. A social media company shall segregate
8
9 any personal information gathered specifically for reasonable age
9
10 verification purposes and shall not use the personal information for
10
11 any other purpose except those provided in subparagraphs a through f
11
12 of paragraph 2 of subsection D of this section.
12
13 2. If a user is determined to be a minor, a social media
13
14 platform shall:
14
15 a. set default privacy settings to prioritize maximum
15
16 privacy of such minor user's account, including
16
17 settings that:
17
18 (1) restrict the visibility of the minor user's
18
19 account to only connected accounts,
19
20 (2) limit the minor user's ability to share content
20
21 to only connected accounts,
21
22 (3) restrict any data collection and sale of data
22
23 from a minor user's account that is not otherwise
23

1 required for core functioning of the social media
1
2 platform,
2
3 (4) disable search engine indexing of the minor
3
4 user's profiles,
4
5 (5) restrict a minor user's direct messaging
5
6 capabilities to only allow for direct messaging
6
7 to connected accounts, and
7
8 (6) allow a minor user to download a file with all
8
9 information associated with his or her account,
9
10 b. implement and maintain reasonable security measures,
10
11 including data encryption, to protect the
11
12 confidentiality, security, and integrity of personal
12
13 information collected from a minor user who is a
13
14 resident of this state,
14
15 c. provide an easily accessible and understandable notice
15
16 that:
16
17 (1) describes any information the social media
17
18 platform collects from a minor user, and
18
19 (2) explains how the information may be used or
19
20 disclosed, and
20
21 d. disable the following features that prolong engagement
21
22 on a social media platform by a minor user:
22
23 (1) autoplay functions that continuously play content
23
24 without user interaction,

1 (2) scroll or pagination that loads additional

2 content as long as the user continues scrolling,
2
3 and
3
4 (3) push notifications prompting repeated user
4
5 engagement.

6 3. Upon request of a minor user, a social media platform shall:
6
7 a. delete the personal information of the minor user,
7
8 unless the information is required to be retained
8
9 pursuant to state or federal law, and
9
10 b. remove any information or material the minor user made
10
11 publicly available through the social media platform.
11
12 C. A social media company shall offer supervisory tools for a
12
13 minor user that the minor user may decide to activate. Such
13
14 supervisory tools shall include capabilities for a parent or legal
14
15 guardian of the minor user to:
15
16 1. Set time limits for the minor user's daily social media
16
17 service usage across devices;
17
18 2. Schedule mandatory breaks for the minor user during selected
18
19 days and times across devices;
19
20 3. View:
20
21 a. data detailing the minor user's total and average
21
22 daily time spent on the social media platform across
22
23 devices,
23
24 b. a list of connected accounts,

1 c. a list of accounts blocked by the minor user, and
1
2 d. the minor user's:
2
3 (1) privacy settings,
3
4 (2) content sensitivity settings, and
4
5 (3) direct messaging settings and permissions; and
5
6 4. Receive notifications when the minor user changes an account
6
7 setting described in this subsection.
7
8 D. 1. A social media platform shall not allow a minor user who
8
9 is a resident of this state to change the default data privacy
9
10 setting provided for in subparagraph a of paragraph 2 of subsection
10
11 B of this section without first obtaining verifiable written consent
11
12 from a minor user's parent or legal guardian. The social media
12
13 platform shall verify the identity of the person consenting and the
13
14 relationship of the person consenting to the minor.
14
15 2. A social media platform's terms of service related to a
15
16 minor user who is a resident of this state shall be presumed to
16
17 include an assurance of confidentiality for the minor user's
17
18 personal information. The presumption of confidentiality may be
18
19 overcome if the social media platform obtains verifiable written
19
20 consent from a parent or legal guard of the minor user. The
20
21 presumption of confidentiality does not apply to a social media
21
22 platform's internal use or external sharing of a minor user's
22
23 personal information if the use or sharing is necessary to:

1 a. maintain or analyze functioning of the social media
1
2 service,
2
3 b. enable network communications,
3
4 c. personalize the user's experience based on the user's
4
5 age and location,
5
6 d. display a username chosen by the minor user,
6
7 e. obtain reasonable age verification information as
7
8 required by paragraph 1 of subsection B of this
8
9 section, or
9
10 f. comply with the requirements of this act or any other
10
11 federal or state law.
11
12 E. A social media platform shall:
12
13 1. Implement a review process allowing a user to appeal his or
13
14 her age designation by submitting documentary evidence to establish
14
15 the user's age range; and
15
16 2. Review evidence submitted by the user and make a
16
17 determination within thirty (30) days of submission of the evidence.
17
18 F. The provisions of this section shall not apply to a text
18
19 messaging platform or a platform for which the primary purpose is
19
20 related to education or health care.
20
21 G. The Attorney General is authorized to bring a civil action
21
22 against a social media platform for a violation of the provisions of
22
23 this section and to seek injunctive relief or other appropriate
23
24 relief as determined by the court.

1 SECTION 2. This act shall become effective November 1, 2025.
