7   An Act relating to distributed energy resources;

7   defining terms; construing provision; establishing

8   provisions for electricity generation and maintenance

8   for microgrids; providing for codification; and

9   providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.    NEW LAW  A new section of law to be codified

13

14 in the Oklahoma Statutes as Section 158.71 of Title 17, unless there
14

15 is created a duplication in numbering, reads as follows:

16  A. For the purposes of this section:

16

17  1. "Distributed energy resource" means a small-scale electrical

17

18 power source that is installed near where the electricity is used
18

19 including, but not limited to, dispatchable or non-dispatchable
19

20 power generation, energy storage resources, energy efficiency
20

21 resources, or demand response resources;

22  2. "Island mode" means an electric generation system that

22

23 operates independently from the public utility grid;

1   3. "Microgrid" means a group of interconnected loads and

2 distributed energy resources within clearly defined electrical
2

3 boundaries that act as a single controllable entity with respect to
3

4 the electric grid and can operate connected or disconnected from the
4

5 public utility grid;
5

6   4. "Owner" or "operator" means a corporation, association,

6

7 company, or individual that owns or operates a distributed energy
7

8 resource to provide electrical service to a microgrid; and
8

9   5. "Public utility" means a public utility as defined pursuant

9

10 to Section 151 of Title 17 of the Oklahoma Statutes; provided,
10

11 however, the term shall not include an owner or operator that
11

12 constructs, maintains, or operates a microgrid in island mode.
12

13  B. Nothing in this section shall be construed to relieve a

13

14 microgrid that is connected to a public utility grid from complying
14

15 with any state or federal regulations, registration requirements,
15

16 and fee payments, including those mandated by the Southwest Power
16

17 Pool, if applicable.
17

18  C. A microgrid owner or operator shall not construct or

18

19 maintain electric lines, including poles or other related
19

20 structures, in, around, or along any road, street, or other public
20

21 way, unless:

22  1. The owner or operator, or a contractor hired by the owner or

22

23 operator to construct the electric line, provides to the Corporation
23

24 Commission a performance bond in the amount of the value of the

1 line, including poles or other related structures to be located in
1

2 the public way. The performance bond shall be enforceable for one
2

3 (1) year from the date that the line is energized; and
3

4   2. Prior to constructing the line, the transmission and

4

5 distribution utility providers who operate the service territory
5

6 where the line is proposed to be built are notified in writing.
6

7   D. If an objection to construction of an electric line built

7

8 under subsection C of this section is filed with the Corporation
8

9 Commission by a public utility and, following adequate notice and
9

10 hearing, the Commission finds that the line is not duplicative of
10

11 existing transmission and distribution lines and does not interfere
11

12 with the delivery of electricity to any consumers, the microgrid
12

13 owner or operator may proceed with the construction or maintenance
13

14 of electric lines after compliance with paragraphs 1 and 2 of
14

15 subsection C of this section.

16  SECTION 2. This act shall become effective November 1, 2025.
