7 An Act relating to assault and battery; defining
7 term; creating misdemeanor and felony offenses;
8 providing for penalties; requiring certain signage;
8 providing for codification; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 650.12 of Title 21, unless there
14
15 is created a duplication in numbering, reads as follows:
15
16 A. As used in this section, "county employee" means any person
16
17 employed by a county, including any duly appointed person, or an
17
18 employee of a firm contracting with a county.

19 B. Any person who, without justifiable or excusable cause,
19
20 commits any assault, battery, or assault and battery upon the person
20
21 of a county employee while such employee is in the performance of
21
22 his or her duties shall, upon conviction, be guilty of a misdemeanor
22
23 punishable by imprisonment in the county jail for a period not to
23

1 exceed one (1) year, a fine not to exceed One Thousand Dollars

2 ($1,000.00), or by both such imprisonment and fine.

3 C. Any person who, without justifiable or excusable cause,
3
4 commits any aggravated battery or aggravated assault and battery
4
5 upon the person of a county employee shall, upon conviction, be
5
6 guilty of a felony punishable by imprisonment in the custody of the
6
7 Department of Corrections for a term not to exceed two (2) years, a
7
8 fine not to exceed Five Thousand Dollars ($5,000.00), or by both
8
9 such imprisonment and fine.

10 D. Every county site shall post in a prominent place a notice
10
11 having the following or similar language: "FELONY CHARGES MAY BE
11
12 FILED AGAINST ANY PERSON(S) COMMITTING AN AGGRAVATED ASSAULT OR
12
13 BATTERY UPON ANY COUNTY EMPLOYEE."

14 SECTION 2. This act shall become effective November 1, 2025.
