6 An Act relating to substance abuse services; amending
6 Section 1, Chapter 311, O.S.L. 2023 (43A O.S. Supp.
7 2024, Section 2-401.1), which relates to emergency
7 opioid antagonists; requiring the Department of
8 Mental Health and Substance Abuse Services to provide
8 emergency opioid antagonists and certain training to
9 specified school personnel and boards of education
9 under specified conditions; amending 70 O.S. 2021,
10 Section 1210.242, as amended by Section 1, Chapter
10 219, O.S.L. 2023 (70 O.S. Supp. 2024, Section
11 1210.242), which relates to schools; making certain
11 training mandatory; requiring boards of education of
12 public school districts to provide certain personnel
12 with emergency opioid antagonists under specified
13 condition; updating statutory references; providing
13 an effective date; and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. AMENDATORY Section 1, Chapter 311, O.S.L.
17
18 2023 (43A O.S. Supp. 2024, Section 2-401.1), is amended to read as
18
19 follows:
19
20 Section 2-401.1. A. As used in this section, "emergency opioid
20
21 antagonist" means a drug including but not limited to naloxone that
21
22 blocks the effects of opioids and that is approved by the United
22
23 States Food and Drug Administration for the treatment of an opioid
23
24 overdose.

1 B. Subject to allocation of federal funding for the purchase of
1
2 emergency opioid antagonists, the Department of Mental Health and
2
3 Substance Abuse Services shall provide emergency opioid antagonists
3
4 to the:
4
5 1. The Department of Corrections and to county jails for the
5
6 purpose of implementing Section 2 of this act 4.1 of Title 57 of the
6
7 Oklahoma Statutes; and
7
8 2. Boards of education of public school districts for the
8
9 purpose of implementing Section 1210.242 of Title 70 of the Oklahoma
9
10 Statutes.

11 C. The Department of Mental Health and Substance Abuse Services
11
12 shall prepare and provide an opioid overdose education program to
12
13 the:
13
14 1. The Department of Corrections and to county jails for the
14
15 purpose of implementing Section 2 of this act 4.1 of Title 57 of the
15
16 Oklahoma Statutes; and
16
17 2. School personnel authorized to administer an emergency
17
18 opioid antagonist under Section 1210.242 of Title 70 of the Oklahoma
18
19 Statutes at the request of the board of education of the public
19
20 school district.
20
21 D. The education program shall:
21
22 1. Conform to guidelines of the Substance Abuse and Mental
22
23 Health Services Administration for opioid overdose education;
23
24 2. Explain the causes of an opioid overdose;

1 3. Instruct when and how to administer in accordance with

2 medical best practices:
2
3 a. life-saving rescue techniques, and
3
4 b. an emergency opioid antagonist;
4
5 4. Explain how to contact appropriate emergency medical
5
6 services; and
6
7 5. Provide information on how to access emergency opioid
7
8 antagonists.
8
9 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.242, as
9
10 amended by Section 1, Chapter 219, O.S.L. 2023 (70 O.S. Supp. 2024,
10
11 Section 1210.242), is amended to read as follows:
11
12 Section 1210.242. A. Any school nurse, public health nurse,
12
13 licensed practitioner of the healing arts, nurse working under
13
14 contract with a school district or any person designated by the
14
15 school administration to administer an emergency opioid antagonist
15
16 in the event of a suspected overdose is authorized, regardless of
16
17 whether there is a prescription or standing order in place, to
17
18 administer an emergency opioid antagonist when encountering a
18
19 student or other individual exhibiting signs of an opioid overdose.
19
20 B. The administration of a public school may authorize one or
20
21 more persons Persons employed by the school to who are authorized to
21
22 administer emergency opioid antagonists under this section shall
22
23 receive training offered by the Department of Mental Health and
23
24 Substance Abuse Services, a law enforcement agency or any other
24

1 entity in recognizing the signs of an opioid overdose and
1
2 administering an emergency opioid antagonist. Persons designated to
2
3 receive this training may include, but are not limited to, the
3
4 certified and noncertified staff members required to receive annual
4
5 training in cardiopulmonary resuscitation and the Heimlich maneuver
5
6 under Section 1210.199 of this title. If in-person training is not
6
7 readily available in the area, the person or persons designated
7
8 under this provision may access emergency opioid antagonist training
8
9 materials available online through the State Department of Health or
9
10 another entity. Such training shall include information on how to
10
11 spot symptoms of an overdose, instruction in basic resuscitation
11
12 techniques, instruction on proper administration of an emergency
12
13 opioid antagonist and the importance of calling 911 for help.
13
14 C. In the absence of the person or persons specifically
14
15 designated and trained to administer an emergency opioid antagonist
15
16 under the provisions of this section, the administration of a school
16
17 may authorize any person, regardless of whether there is a
17
18 prescription or standing order in place, to administer an emergency
18
19 opioid antagonist to a student or other individual exhibiting signs
19
20 of an overdose.

21 D. Any person administering an emergency opioid antagonist to a
21
22 student or other individual at a school site or school-sponsored
22
23 event in a manner consistent with addressing opioid overdose shall
23
24 be covered under the Good Samaritan Act. A school and any of its

1 employees or designees shall be immune from civil liability in
1
2 relation to the administration of an emergency opioid antagonist in
2
3 the event of a suspected overdose.

4 E. Subject to the provision of emergency opioid antagonists by
4
5 the Department of Mental Health and Substance Abuse Services under
5
6 Section 2-401.1 of Title 43A of the Oklahoma Statutes, the board of
6
7 education of a public school district shall provide school personnel
7
8 authorized to administer an emergency opioid antagonist under this
8
9 section with doses of emergency opioid antagonists to carry on their
9
10 person or keep in their classrooms or workspaces in the event of an
10
11 overdose.

12 F. As used in this section, "emergency opioid antagonist" means
12
13 a drug including but not limited to naloxone that blocks the effects
13
14 of opioids and that is approved by the United States Food and Drug
14
15 Administration for the treatment of an opioid overdose.
15
16 SECTION 3. This act shall become effective July 1, 2025.
16
17 SECTION 4. It being immediately necessary for the preservation
17
18 of the public peace, health or safety, an emergency is hereby
18
19 declared to exist, by reason whereof this act shall take effect and
19
20 be in full force from and after its passage and approval.
