6   An Act relating to the practice of pharmacy; amending

6   59 O.S. 2021, Section 353.18A, which relates to

7   pharmacy technicians; updating statutory language;

7   establishing certain pharmacy staffing ratio; and

8   providing an effective date.

10 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

11  SECTION 1.     AMENDATORY   59 O.S. 2021, Section 353.18A, is

11

12 amended to read as follows:
12

13  Section 353.18A. A. Supportive personnel may perform certain

13

14 tasks in the practice of pharmacy if such personnel perform the
14

15 tasks in compliance with rules promulgated by the State Board of
15

16 Pharmacy.
16

17  B. 1. No person shall serve as a pharmacy technician without

17

18 first procuring a permit from the Board.
18

19  2. An application for an initial or renewal pharmacy technician

19

20 permit issued pursuant to the provisions of this subsection shall be
20

21 submitted to the Board and provide any other information deemed
21

22 relevant by the Board.

23  3. An application for an initial or renewal permit shall be

23

24 accompanied by a permit fee not to exceed Seventy Five Seventy-five

1 Dollars ($75.00) for each period of one (1) year. A permit issued
1

2 pursuant to this subsection shall be valid for a period to be
2

3 determined by the Board.

4   4. Every permitted pharmacy technician who fails to complete a

4

5 renewal form and remit the required renewal fee to the Board by the
5

6 fifteenth day after the expiration of the permit shall pay a late
6

7 fee to be fixed by the Board.

8   5. A pharmacy technician permit shall be cancelled canceled

8

9 thirty (30) days after expiration.
9

10  6. A person may obtain reinstatement of a cancelled canceled

10

11 pharmacy technician permit by making application, paying a
11

12 reinstatement fee, and satisfactorily completing other requirements
12

13 set by the Board.
13

14  C. A licensed retail pharmacy shall maintain a pharmacy

14

15 technician-to-pharmacist ratio of not more than five pharmacy
15

16 technicians for every one licensed pharmacist.
16

17  SECTION 2. This act shall become effective November 1, 2025.
