6 An Act relating to controlled dangerous substances;
6 ordering a legislative referendum pursuant to the
7 Oklahoma Constitution; creating felony offense;
7 providing penalty; providing for codification;
8 providing ballot title; and directing filing.

10 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

11 SECTION 1. Pursuant to Section 3 of Article V of the Oklahoma
11
12 Constitution, there is hereby ordered the following legislative
12
13 referendum which shall be filed with the Secretary of State and
13
14 addressed to the Governor of the state, who shall submit the same to
14
15 the people for their approval or rejection at the next General
15
16 Election.

17 SECTION 2. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 2-441 of Title 63, unless there
18
19 is created a duplication in numbering, reads as follows:

20 Any person who unlawfully possesses a controlled dangerous
20
21 substance while also in possession of a firearm shall, upon
21
22 conviction, be guilty of a felony punishable by imprisonment in the
22
23 custody of the Department of Corrections for a term not more than
23
24 five (5) years.

1 SECTION 3. The Ballot Title for the proposed act shall be in

5 THE GIST OF THE PROPOSITION IS AS FOLLOWS:

6 This measure adds a new section of law related to controlled
6
7 dangerous substances. The measure creates a felony offense for
7
8 being in possession of a firearm while also in possession of a
8
9 controlled dangerous substance.

13 SECTION 4. The President Pro Tempore of the Senate shall,

14 immediately after the passage of this act, shall prepare and file
14
15 one copy thereof, including the Ballot Title set forth in SECTION 3

16 hereof, with the Secretary of State and one copy with the Attorney
16
17 General.
