7 An Act relating to the Oklahoma Central Purchasing
7 Act; amending 74 O.S. 2021, Section 85.5a, which
8 relates to the state purchase card program; allowing
8 certain political subdivisions to issue solicitation
9 for certain purchase card acquisition; and providing
9 an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 74 O.S. 2021, Section 85.5a, is
13
14 amended to read as follows:
14
15 Section 85.5a. A. Except for the state fleet card, the state
15
16 purchase card program administered by the Purchasing Division is the
16
17 only card program authorized for use by state agencies.
17
18 B. On a monthly basis the State Purchasing Director and
18
19 institutions of higher education shall provide to the Director of
19
20 the Office of Management and Enterprise Services (OMES) a complete
20
21 listing in electronic format of all transactions paid by a state
21
22 purchase card. The list shall contain the name of the purchaser and
22
23 purchasing agency, amount of purchase and all available descriptions
23
24 of items purchased.

1 C. Upon receipt of the list described in subsection B of this
1
2 section, the Director of the OMES shall allow the public access to
2
3 the list in searchable format through its website defined in Section
3
4 46 of Title 62 of the Oklahoma Statutes.

5 D. The State Purchasing Director may authorize the use of a
5
6 state purchase card for acquisitions within the following
6
7 parameters:

8 1. No limit on the amount of the transaction for the following:
8
9 a. purchases from statewide contracts and from contracts
9
10 awarded by the State Purchasing Director for the
10
11 benefit of a state agency,
11
12 b. utilities,
12
13 c. interagency payments,
13
14 d. emergency acquisitions; provided, requirements to
14
15 establish an emergency pursuant to Section 5 of this
15
16 act or other applicable statute or rule have been met,
16
17 and
17
18 e. professional services as defined in Section 803 of
18
19 Title 18 of the Oklahoma Statutes; and
19
20 2. For any other transaction with a state purchase card, the
20
21 transaction shall not exceed the greater of Five Thousand Dollars
21
22 ($5,000.00) or the limit determined by the State Purchasing
22
23 Director, not to exceed the fair and reasonable acquisition
23
24 threshold amount.

1 E. The State Purchasing Director may authorize personnel of the

2 Department of Commerce, upon a finding by the Secretary of Commerce
2
3 that such personnel have a legitimate need therefore, to utilize a
3
4 state purchase card for acquisitions for programs, functions or
4
5 services essential to the mission of the agency while traveling on
5
6 Department of Commerce business in foreign locations with
6
7 transaction limits not to exceed Thirty-five Thousand Dollars
7
8 ($35,000.00). The purchase cardholders are required to sign a
8
9 purchase card agreement prior to becoming a cardholder and to attend
9
10 purchase card procedure training. The Department of Commerce will
10
11 conduct quarterly internal auditing on all purchase card
11
12 transactions associated with business and travel in foreign
12
13 locations.

14 F. Any political subdivision participating in the state
14
15 purchase card program may issue a solicitation pursuant to the
15
16 provisions Section 85.7 of this title for the acquisition of a
16
17 purchase card.

18 SECTION 2. This act shall become effective November 1, 2025.
