7 An Act relating to construction by political
7 subdivisions; amending 61 O.S. 2021, Section 108,
8 which relates to written statements; removing
8 requirement for certain statements to be disclosed
9 under oath; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 61 O.S. 2021, Section 108, is
13
14 amended to read as follows:
14
15 Section 108. Each bidder shall accompany the bid with a written
15
16 statement under oath disclosing the following information:
16
17 1. The nature of any partnership, joint venture or other
17
18 business relationships then in effect or which existed within one
18
19 (1) year prior to the date of such statement with the architect,
19
20 engineer or other party to the project;
20
21 2. Any such business relationship then in effect or which
21
22 existed within one (1) year prior to the date of such statement
22
23 between any officer or director of the bidding company and any
23

1 officer or director of the architectural or engineering firm or
1
2 other party to the project; and
2
3 3. The names of all persons having any such business
3
4 relationships and the positions they hold with their respective
4
5 companies or firms. If none of the business relationships
5
6 hereinabove mentioned exist, then a statement to that effect.
6
7 SECTION 2. It being immediately necessary for the preservation
7
8 of the public peace, health or safety, an emergency is hereby
8
9 declared to exist, by reason whereof this act shall take effect and
9
10 be in full force from and after its passage and approval.
