20 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

21 SECTION 1. AMENDATORY 11 O.S. 2021, Section 56-101, is
21
22 amended to read as follows:
22
23 Section 56-101. Sections 11 56-101 through 20 56-110 of this
23
24 act title shall be the provisions of the Local Government Campaign

1 Finance and Financial Disclosure Act applicable to municipalities
1
2 and shall be known as the "Municipal Campaign Finance and Financial
2
3 Disclosure Act".

4 SECTION 2. AMENDATORY 11 O.S. 2021, Section 56-102, is
4
5 amended to read as follows:
5
6 Section 56-102. A. Definitions of terms used in the Municipal
6
7 Campaign Finance and Financial Disclosure Act shall be the same as
7
8 those terms are defined in Rules of the Ethics Commission
8
9 promulgated pursuant to Section 3 of Article XXIX of the Oklahoma
9
10 Constitution, unless otherwise provided herein.
10
11 B. As used in the Municipal Campaign Finance and Financial
11
12 Disclosure Act:
12
13 1. "Campaign committee" means a committee which may be composed
13
14 of one or more persons the purpose of which is to support the
14
15 election of a specific candidate to municipal office, whose name as
15
16 it will appear on the ballot shall appear in the name of the
16
17 committee;
17
18 2. "Municipal office" means any elective municipal office
18
19 established under state or municipal law; and
19
20 3. "Municipal political committee" means any committee composed
20
21 of one or more persons whose purpose includes the election or defeat
21
22 of one or more candidates for municipal office but which is not
22
23 required to register with the Ethics Commission or the Federal
23
24 Election Commission.

2 amended to read as follows:

3 Section 56-104. Each campaign committee shall file a statement
3
4 of organization with the municipal clerk Ethics Commission subject

5 to the same requirements as set forth for candidate committees for
5
6 state office required to file statements of organization with the
6
7 Ethics Commission under Rules of the Ethics Commission promulgated
7
8 pursuant to Section 3 of Article XXIX of the Oklahoma Constitution,

9 including but not limited to time for filing and contents.

6 to time for filing and contents.

7 SECTION 6. AMENDATORY 11 O.S. 2021, Section 56-107, is

8 amended to read as follows:

9 Section 56-107. Statements of organization and reports of
9
10 contributions and expenditures required to be filed with the
10
11 municipal clerk Ethics Commission under the Municipal Campaign
11
12 Finance and Financial Disclosure Act shall be public records. The
12
13 municipal clerk Ethics Commission shall maintain statements of
13
14 organization and reports of contributions and expenditures for four
14
15 (4) years after the date on which they are filed, if not posted on
15
16 the municipality's Ethics Commission website as provided herein, at
16
17 which time the documents may be destroyed or retained subject to the
17
18 discretion of the municipal clerk Ethics Commission. If the
18
19 municipality in which the statements of organization and reports of
19
20 contributions and expenditures are filed maintains an Internet
20
21 website, the municipal clerk The Ethics Commission may post on the
21
22 website copies of statements of organization and reports of
22
23 contributions and expenditures.

3 Section 56-108. All candidates for municipal office and all

4 elected municipal officers shall be required to file a statement of

5 financial interests with the municipal clerk Ethics Commission
5
6 subject to the same requirements as set forth for candidates for
6
7 state office required to file statements of financial interests with
7
8 the Ethics Commission under Rules of the Ethics Commission
8
9 promulgated pursuant to Section 3 of Article XXIX of the Oklahoma
9
10 Constitution, including but not limited to time for filing and
10
11 contents.

12 SECTION 8. AMENDATORY 11 O.S. 2021, Section 56-109, is

13 amended to read as follows:

14 Section 56-109. Statements of financial interests required to
14
15 be filed with the municipal clerk Ethics Commission under the
15
16 Municipal Campaign Finance and Financial Disclosure Act shall be

17 public records. The municipal clerk Ethics Commission shall
17
18 maintain statements of financial interests for four (4) years after
18
19 the date on which they are filed, if not posted on the
19
20 municipality's Ethics Commission's website as provided herein, at
20
21 which time the documents may be destroyed or retained subject to the
21
22 discretion of the municipal clerk Ethics Commission. If the
22
23 municipality in which the statements of financial interests are
23

3 SECTION 9. AMENDATORY 11 O.S. 2021, Section 56-110, is
3
4 amended to read as follows:
4
5 Section 56-110. The Municipal Campaign Finance and Financial
5
6 Disclosure Act shall be enforced by the Ethics Commission in the
6
7 same manner as Rules of the Ethics Commission promulgated pursuant
7
8 to Section 3 of Article XXIX of the Oklahoma Constitution are
8
9 enforced, including but not limited to acceptance of complaints,
9
10 civil prosecutions, settlement agreements and any other compliance
10
11 practices or requirements. Complaints may be received by the Ethics
11
12 Commission alleging filing of statements or reports required to be
12
13 filed under the Municipal Campaign Finance and Financial Disclosure
13
14 Act later than the prescribed time for filing. Such complaints
14
15 shall be in the same form as other complaints made according to the
15
16 Rules of the Ethics Commission promulgated pursuant to Section 3 of
16
17 Article XXIX of the Oklahoma Constitution. Upon receipt of such
17
18 complaints of late filing, the Ethics Commission shall investigate
18
19 whether the allegation or allegations are true and, if so, shall
19
20 assess a late filing penalty of One Hundred Dollars ($100.00) per
20
21 day, not to exceed a maximum of One Thousand Dollars ($1,000.00) for
21
22 the filing of any statement or report. If the Ethics Commission
22
23 determines the allegation or allegations are not true, it shall take
23
24 no further action. Persons assessed a late filing fee may protest
24

1 the assessment subject to provisions of the Administrative
1
2 Procedures Act.

3 SECTION 10. AMENDATORY 19 O.S. 2021, Section 138.11, is
3
4 amended to read as follows:
4
5 Section 138.11. Sections 2 138.11 through 10 138.19 of this act
5
6 title shall be the provisions of the Local Government Campaign
6
7 Finance and Financial Disclosure Act applicable to counties and
7
8 shall be known as the "County Campaign Finance and Financial
8
9 Disclosure Act".

10 SECTION 11. AMENDATORY 19 O.S. 2021, Section 138.12, is
10
11 amended to read as follows:
11
12 Section 138.12. A. Definitions of terms used in the County
12
13 Campaign Finance and Financial Disclosure Act shall be the same as
13
14 those terms are defined in Rules of the Ethics Commission
14
15 promulgated pursuant to Section 3 of Article XXIX of the Oklahoma
15
16 Constitution, unless otherwise provided herein.

17 B. As used in the County Campaign Finance and Financial
17
18 Disclosure Act:

3 3. "County political committee" means any committee composed of
3
4 one or more persons whose purpose includes the election or defeat of
4
5 one or more candidates for county office but which is not required
5
6 to register with the Ethics Commission or the Federal Election
6
7 Commission.

8 SECTION 12. AMENDATORY 19 O.S. 2021, Section 138.13, is
8
9 amended to read as follows:
9
10 Section 138.13. Each campaign committee shall file a notarized
10
11 statement of organization with the county election board Ethics
11
12 Commission subject to the same requirements as set forth for
12
13 candidate committees for state office to file statements of
13
14 organization with the Ethics Commission under Rules of the Ethics
14
15 Commission promulgated pursuant to Section 3 of Article XXIX of the
15
16 Oklahoma Constitution, including but not limited to time for filing
16
17 and contents, except as otherwise provided in the County Campaign
17
18 Finance and Financial Disclosure Act. The statement of organization
18
19 shall be accompanied by a check drawn upon the campaign committee's
19
20 account in the amount of Fifty Dollars ($50.00) as a nonrefundable
20
21 processing fee to be deposited in the County Election Board Special
21
22 Depository Account. Expenditures from such fees may be made by the
22
23 secretary of the county election board for any lawful purpose.

1 SECTION 13. AMENDATORY 19 O.S. 2021, Section 138.14, is

2 amended to read as follows:

3 Section 138.14. Every county political committee shall file a
3
4 notarized statement of organization with the county election board
4
5 Ethics Commission subject to the same requirements as set forth for
5
6 political committees required to file statements of organization
6
7 with the Ethics Commission under Rules of the Ethics Commission
7
8 promulgated pursuant to Section 3 of Article XXIX of the Oklahoma
8
9 Constitution, including but not limited to time for filing and
9
10 contents.

11 SECTION 14. AMENDATORY 19 O.S. 2021, Section 138.15, is
11
12 amended to read as follows:

13 Section 138.15. Every campaign committee and every county
13
14 political committee shall file reports of contributions and
14
15 expenditures with the county election board Ethics Commission
15
16 subject to the same requirements as set forth for reports of
16
17 contributions and expenditures filed with the Ethics Commission
17
18 under Rules of the Ethics Commission promulgated pursuant to Section
18
19 3 of Article XXIX of the Oklahoma Constitution, including but not
19
20 limited to time for filing and contents.

21 SECTION 15. AMENDATORY 19 O.S. 2021, Section 138.16, is
21
22 amended to read as follows:

23 Section 138.16. Statements of organization and reports of
23
24 contributions and expenditures required under the County Campaign

5
6 herein, at which time the documents may be destroyed or retained at
6
7 the discretion of the county election board Ethics Commission. If

8 the county in which the statements of organization are filed
8
9 maintains an Internet website, the county election board The Ethics
9
10 Commission may post on the website copies of statements of
10
11 organization and reports of contributions and expenditures.

12 SECTION 16. AMENDATORY 19 O.S. 2021, Section 138.17, is

13 amended to read as follows:

14 Section 138.17. All candidates for county office and all
14
15 elected county officers shall be required to file a notarized

6 SECTION 18. AMENDATORY 19 O.S. 2021, Section 138.19, is

7 amended to read as follows:

8 Section 138.19. The County Campaign Finance and Financial
8
9 Disclosure Act shall be enforced by the Ethics Commission in the
9
10 same manner as Rules of the Ethics Commission promulgated pursuant
10
11 to Section 3 of Article XXIX of the Oklahoma Constitution are
11
12 enforced, including but not limited to acceptance of complaints,

7 SECTION 19. AMENDATORY 70 O.S. 2021, Section 2-110, is

8 amended to read as follows:

9 Section 2-110. Sections 21 2-110 through 30 2-119 of this act
9
10 title shall be the provisions of the Local Government Campaign
10
11 Finance and Financial Disclosure Act applicable to technology center
11
12 districts and independent school districts and shall be known as the
12
13 "Technology Center District and Independent School District Campaign
13
14 Finance and Financial Disclosure Act".

15 SECTION 20. AMENDATORY 70 O.S. 2021, Section 2-111, is
15
16 amended to read as follows:

17 Section 2-111. A. Definitions of terms used in the Technology
17
18 Center District and Independent School District Campaign Finance and
18
19 Financial Disclosure Act shall be the same as those terms are
19
20 defined in Rules of the Ethics Commission promulgated pursuant to
20
21 Section 3 of Article XXIX of the Oklahoma Constitution, unless
21
22 otherwise provided herein.

23 B. As used in the Technology Center District and Independent
23
24 School District Campaign Finance and Disclosure Act:

9 office for which Declarations of Candidacy are filed with the

10 secretary of the county election board as required by Section 13A-

11 105 of Title 26 of the Oklahoma Statutes; and

12 4. "School district political committee" means any committee
12
13 composed of one or more persons whose purpose includes the election
13
14 or defeat of one or more candidates for school district office but
14
15 which is not required to register with the Ethics Commission or the
15
16 Federal Election Commission.

17 SECTION 21. AMENDATORY 70 O.S. 2021, Section 2-113, is
17
18 amended to read as follows:

15 Commission's website as provided herein, at which time the documents
15

23 Section 2-119. The Technology Center District and Independent
23
24 School District Campaign Finance and Financial Disclosure Act shall
