8 drugs; providing administrative and criminal

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 1-758.1 of Title 63, unless
18
19 there is created a duplication in numbering, reads as follows:

20 A. As used in this section:
20
21 1. "Abortion" means the use or prescription of any instrument,
21
22 medicine, drug, or any other substance or device intentionally to
22
23 terminate the pregnancy of a female known to be pregnant with an
23
24 intention other than to increase the probability of a live birth, to

1 preserve the life or health of the unborn person after live birth,
1
2 or to remove a dead unborn person who died as the result of a
2
3 spontaneous miscarriage, accidental trauma, or a criminal assault on
3
4 the pregnant female or her unborn person; and
4
5 2. "Abortion-inducing drug" means a medicine, drug, or any
5
6 other substance prescribed or dispensed with the intent of
6
7 terminating the pregnancy of a woman known to be pregnant, with
7
8 knowledge that the termination will with reasonable likelihood cause
8
9 the death of the unborn person. This includes the off-label use of
9
10 drugs known to have abortion-inducing properties, which are
10
11 prescribed specifically with the intent of causing an abortion, such
11
12 as mifepristone (Mifeprex), misoprostol (Cytotec), and methotrexate.
12
13 This definition does not apply to drugs that may be known to cause
13
14 an abortion, but which are prescribed for other medical indications,
14
15 such as chemotherapeutic agents and diagnostic drugs. The use of
15
16 such drugs to induce abortion is also known as "medical",
16
17 "medication", "RU�486", "chemical", "Mifeprex regimen", or "drug-
17
18 induced" abortion.

19 B. No person shall knowingly or recklessly give, sell,
19
20 dispense, administer, prescribe, distribute, traffic, or otherwise
20
21 provide to any other person in this state an abortion-inducing drug
21
22 to be used for the purpose of inducing an abortion in violation of
22
23 Section 861 of Title 21 of the Oklahoma Statutes or for the purpose

1 of inducing labor with the intent to cause the death of the unborn

2 person after live birth through intentional or negligent acts.

3 C. In addition to such other penalties as may be prescribed by
3
4 law:
4
5 1. Any person including, but not limited to, a health care
5
6 provider as described in paragraph 2 of this subsection who is found
6
7 to be in violation of this section shall, upon conviction, be guilty
7
8 of a felony; and
8
9 2. The licensing board of any health care provider found to be
9
10 in violation of this section shall immediately revoke the health
10
11 care provider's professional license.

12 SECTION 2. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 1-758.2 of Title 63, unless
13
14 there is created a duplication in numbering, reads as follows:

15 If any provision, word, phrase, or clause of this act or the
15
16 application thereof to any person or circumstance is held invalid,
16
17 such invalidity shall make the entire act invalid and to this end,
17
18 the provisions, words, phrases, and clauses of this act are declared
18
19 to be inseverable.

20 SECTION 3. REPEALER 63 O.S. 2021, Sections 1-729a, 1-
20
21 729.1, 1-729.2, 1-729.3, 1-729.4, 1-729.5, 1-729.6, 1-729.7, 1-756,
21
22 1-756.1, 1-756.2, 1-756.3, 1-756.4, 1-756.5, 1-756.6, 1-756.7, 1-
22
23 756.8, 1-756.9, 1-756.10, 1-756.11, 1-756.12, 1-756.13, 1-756.14, 1-
23
24 757.1, 1-757.2, 1-757.3, 1-757.4, 1-757.5, 1-757.6, 1-757.7, 1-
24

1 757.8, 1-757.9, 1-757.10, 1-757.11, 1-757.12, 1-757.13, 1-757.14, 1-

2 757.15, and 1-757.16, are hereby repealed.

3 SECTION 4. It being immediately necessary for the preservation
3
4 of the public peace, health or safety, an emergency is hereby
4
5 declared to exist, by reason whereof this act shall take effect and
5
6 be in full force from and after its passage and approval.
