7   An Act relating to public safety; creating the

7   Oklahoma Public Safety and Immigration Enforcement

8   Act; providing short title; defining terms; requiring

8   development of a Secure Interagency Collaboration

9   Platform; stating certain requirements; requiring the

9   Office of Management and Enterprise Services to

10  oversee the Secure Interagency Collaboration

10  Platform; authorizing promulgation of rules;

11  requiring law enforcement agencies to provide certain

11  report and certain data; requiring the Department of

12  Corrections to conduct certain screening and make

12  certain notification; requiring certain

13  prioritization; requiring certain training;

13  authorizing certain administrative penalty;

14  authorizing the Department of Corrections and the

14  Office of Management and Enterprise Services to seek

15  certain funding; providing for codification;

15  providing an effective date; and declaring an

16  emergency.

20 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
20

21  SECTION 1.     NEW LAW  A new section of law to be codified

21

22 in the Oklahoma Statutes as Section 569 of Title 57, unless there is
22

23 created a duplication in numbering, reads as follows:

1   A. This act shall be known and may be cited as the "Oklahoma

2 Public Safety and Immigration Enforcement Act".
2

3   B. As used in the Oklahoma Public Safety and Immigration

3

4 Enforcement Act:
4

5   1. "Secure Interagency Collaboration Platform" refers to a

5

6 technology system established under this act for data sharing and
6

7 coordination among relevant agencies; and
7

8   2. "Unauthorized immigrant" means a person who does not have

8

9 legal authorization to reside in the United States.
9

10  C. 1. The Office of Management and Enterprise Services shall

10

11 develop and implement a Secure Interagency Collaboration Platform to
11

12 facilitate real-time communication and data sharing among:
12

13  a. law enforcement agencies of this state,

13

14  b. the Department of Corrections, and

14

15  c. federal immigration authorities, including the United

15

16                States Immigration and Customs Enforcement (ICE).

16

17  2. The Secure Interagency Collaboration Platform shall:

17

18  a. integrate existing databases from participating

18

19                agencies to enable comprehensive tracking of

19

20                individuals,

20

21  b. include advanced security measures to protect

21

22                sensitive data and ensure compliance with privacy laws

22

23                of this state,

1   c. provide automated alerts to participating agencies

2                 when an unauthorized immigrant is identified within

2

3                 the criminal justice system, and

3

4   d. offer case management tools to track the status of

4

5                 unauthorized immigrants from arrest to deportation

5

6                 proceedings.

7   3. The Office of Management and Enterprise Services shall

7

8 oversee the development, implementation, and maintenance of the
8

9 Secure Interagency Collaboration Platform and promulgate rules to
9

10 enact the provisions of this subsection.

11  D. 1. Law enforcement agencies within this state shall:

11

12  a. report any arrest of an individual suspected of being

12

13                an unauthorized immigrant to the Department of

13

14                Corrections and federal immigration authorities

14

15                through the Secure Interagency Collaboration Platform,

15

16                and

16

17  b. provide relevant data, including biometric

17

18                information, to facilitate identification and status

18

19                verification of any individual suspected of being an

19

20                unauthorized immigrant.

20

21  2. The Department of Corrections shall:

21

22  a. screen any individual that enters a state correctional

22

23                facility to identify an unauthorized immigrant through

23

1                 the use of the Secure Interagency Collaboration

2                 Platform, and

2

3   b. notify federal immigration authorities of any

3

4                 confirmed unauthorized immigrant who meets the

4

5                 criteria outlined in this act.

5

6   3. Federal immigration authorities shall prioritize cooperation

6

7 with agencies of this state to expedite deportation proceedings for
7

8 any unauthorized immigrant identified pursuant to the provisions of
8

9 this act.

10  E. 1. Any participating agency shall receive training on the

10

11 use of the Secure Interagency Collaboration Platform and the
11

12 requirements of the Oklahoma Public Safety and Immigration
12

13 Enforcement Act.
13

14  2. Any agency that fails to comply with the reporting and

14

15 collaboration requirements provided in this act may be subject to an
15

16 administrative penalty as determined by the Office of Management and
16

17 Enterprise Services.

18  F. The Department of Corrections and the Office of Management

18

19 and Enterprise Services are authorized to seek federal grants and
19

20 other funding sources to implement the provisions of this act.
20

21  SECTION 2. This act shall become effective July 1, 2025.

21

22  SECTION 3. It being immediately necessary for the preservation

22

23 of the public peace, health or safety, an emergency is hereby
23

24

1 declared to exist, by reason whereof this act shall take effect and
1

2 be in full force from and after its passage and approval.
