9 and crimes to which act applies; prohibiting certain
9 agreement; prohibiting removal of certain
10 requirement; prohibiting contact with any minor;
10 updating statutory language and reference; providing
11 for codification; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 57 O.S. 2021, Section 582, as
15
16 amended by Section 14, Chapter 151, O.S.L. 2024 (57 O.S. Supp. 2024,
16
17 Section 582), is amended to read as follows:
17
18 Section 582. A. The provisions of the Sex Offenders
18
19 Registration Act shall apply to any person residing, working, or
19
20 attending school within the State of Oklahoma this state who, after
20
21 November 1, 1989, has been convicted, whether upon a verdict or plea
21
22 of guilty or upon a plea of nolo contendere, or received a suspended
22
23 sentence or any probationary term, or is currently serving a
23
24 sentence or any form of probation or parole for a crime or an

1 attempt to commit a crime provided for in Section 843.5 of Title 21
1
2 of the Oklahoma Statutes if the offense involved sexual abuse or
2
3 sexual exploitation as those terms are defined in Section 1-1-105 of
3
4 Title 10A of the Oklahoma Statutes, Section 681, if the offense
4
5 involved sexual assault, 741, if the offense involved sexual abuse
5
6 or sexual exploitation, Section 748, if the offense involved human
6
7 trafficking for commercial sex, Section 843.1, if the offense
7
8 involved sexual abuse or sexual exploitation, Section 852.1, if the
8
9 offense involved sexual abuse of a child, 856, if the offense
9
10 involved child sex trafficking or human trafficking for commercial
10
11 sex, 865 et seq., 885, 886, 888, 891, if the offense involved sexual
11
12 abuse or sexual exploitation, 1021, 1021.2, 1021.3, 1024.2, 1029, if
12
13 the offense involved child sex trafficking, 1040.8, if the offense
13
14 involved child pornography sexual abuse material, 1040.12a, 1040.13,
14
15 1040.13a, 1087, 1088, 1111.1, 1114, or 1123 of Title 21 of the
15
16 Oklahoma Statutes.

17 B. The provisions of the Sex Offenders Registration Act shall
17
18 apply to any person who after November 1, 1989, resides, works, or
18
19 attends school within the State of Oklahoma this state and who has
19
20 been convicted or received a suspended sentence at any time in any
20
21 court of another state, the District of Columbia, Puerto Rico, Guam,
21
22 American Samoa, the Northern Mariana Islands and the United States
22
23 Virgin Islands, a federal court, an Indian tribal court, a military
23
24 court, or a court of a foreign country for a crime, attempted crime,

1 or a conspiracy to commit a crime which, if committed or attempted

2 in this state, would be a crime, an attempt to commit a crime, or a
2
3 conspiracy to commit a crime provided for in any of the laws listed
3
4 in subsection A of this section.

5 C. The provisions of the Sex Offenders Registration Act shall
5
6 apply to any person who resides, works, or attends school within the
6
7 State of Oklahoma this state and who has received a deferred
7
8 judgment at any time in any court of another state, the District of
8
9 Columbia, Puerto Rico, Guam, American Samoa, the Northern Mariana
9
10 Islands and the United States Virgin Islands, a federal court, an
10
11 Indian tribal court, a military court, or a court of a foreign
11
12 country for a crime, attempted crime, or a conspiracy to commit a
12
13 crime which, if committed or attempted or conspired to be committed
13
14 in this state, would be a crime, an attempt to commit a crime, or a
14
15 conspiracy to commit a crime provided for in Section 843.5 of Title
15
16 21 of the Oklahoma Statutes if the offense involved sexual abuse or
16
17 sexual exploitation as those terms are defined in Section 1-1-105 of
17
18 Title 10A of the Oklahoma Statutes, Section 681, if the offense
18
19 involved sexual assault, 741, if the offense involved sexual abuse
19
20 or sexual exploitation, Section 748, if the offense involved human
20
21 trafficking for commercial sex, Section 843.1, if the offense
21
22 involved sexual abuse or sexual exploitation, Section 852.1, if the
22
23 offense involved sexual abuse of a child, 856, if the offense
23
24 involved child sex trafficking or human trafficking for commercial

1 sex, 865 et seq., 885, 886, 888, 891, if the offense involved sexual
1
2 abuse or sexual exploitation, 1021, 1021.2, 1021.3, 1024.2, 1029, if
2
3 the offense involved child sex trafficking, 1040.8, if the offense
3
4 involved child pornography sexual abuse material, 1040.12a, 1040.13,
4
5 1040.13a, 1087, 1088, 1111.1, 1114, or 1123 of Title 21 of the
5
6 Oklahoma Statutes. The provisions of the Sex Offenders Registration
6
7 Act shall not apply to any such person while the person is
7
8 incarcerated in a maximum or medium correctional institution of the
8
9 Department of Corrections.
9
10 D. On November 1, 2002, any person registered as a sex offender
10
11 pursuant to Section 741 of Title 21 of the Oklahoma Statutes shall
11
12 be summarily removed from the Sex Offender Registry sex offender
12
13 registry by the Department of Corrections and all law enforcement
13
14 agencies of any political subdivision of this state, unless the
14
15 offense involved sexual abuse or sexual exploitation.
15
16 E. The provisions of the Sex Offenders Registration Act shall
16
17 not apply to any such person who has received a criminal history
17
18 records expungement for a conviction in another state for a crime or
18
19 attempted crime which, if committed or attempted in this state,
19
20 would be a crime or an attempt to commit a crime provided for in any
20
21 laws listed in subsection A of this section.

22 F. The provisions of the Sex Offenders Registration Act shall
22
23 apply to any person residing, working, or attending school within
23
24 this state who, after the effective date of this act November 1,

1 2020, has been convicted, whether upon a verdict or plea of guilty
1
2 or upon a plea of nolo contendere, or received a suspended sentence
2
3 or any probationary term, or is currently serving a sentence or any
3
4 form of probation or parole for a crime or an attempt to commit a
4
5 crime as provided for in subsection G of Section 1040.13b of Title
5
6 21 of the Oklahoma Statutes.

7 G. The provisions of the Sex Offenders Registration Act shall
7
8 apply to any person who resides, works, or attends school within
8
9 this state and who has received a deferred judgment at any time in
9
10 any court of another state, the District of Columbia, Puerto Rico,
10
11 Guam, American Samoa, the Northern Mariana Islands and the United
11
12 States Virgin Islands, a federal court, an Indian tribal court, a
12
13 military court, or a court of a foreign country for a crime, if
13
14 committed in this state, would be a crime, as provided for in
14
15 subsection F of Section 1040.13b of Title 21 of the Oklahoma
15
16 Statutes. The provisions of the Sex Offenders Registration Act
16
17 shall not apply to any such person while the person is incarcerated
17
18 in a maximum or medium correctional institution in the custody of
18
19 the Department of Corrections.
19
20 H. Any person who has been convicted, whether upon a verdict or
20
21 plea of guilty or upon a plea of nolo contendere, or received a
21
22 suspended sentence or any probationary term or parole for a crime
22
23 which requires the person to register as a sex offender pursuant to
23
24 the terms of the Sex Offenders Registration Act shall not enter into
24

1 a plea agreement whereby the offender shall be allowed to forgo
1
2 registering as a sex offender.

3 I. The sealing of a criminal record or other action that limits
3
4 the publicity or availability of conviction information shall not
4
5 remove the requirement of an individual to register as a sex
5
6 offender pursuant to the provisions of the Sex Offenders
6
7 Registration Act.

8 SECTION 2. NEW LAW A new section of law to be codified
8
9 in the Oklahoma Statutes as Section 590.3 of Title 57, unless there
9
10 is created a duplication in numbering, reads as follows:
10
11 Any person who is required to register under the provisions of
11
12 the Sex Offenders Registration Act shall not be allowed to have any
12
13 contact with a person under eighteen (18) years of age, including
13
14 the child of such person.
14
15 SECTION 3. This act shall become effective November 1, 2025.
