7 An Act relating to nutrition services; creating the
7 Food is Medicine Act; providing short title; creating
8 certain financial incentive for contracted entities
8 under the state Medicaid program; directing the
9 Oklahoma Health Care Authority to seek federal
9 approval to expand certain nutrition services;
10 describing Food is Medicine Initiative; authorizing
10 certain covered services; directing the State
11 Department of Education to provide technical
11 assistance related to the Oklahoma Farm to School
12 Program Act; providing for noncodification; providing
12 for codification; providing an effective date; and
13 declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. NEW LAW A new section of law not to be
17
18 codified in the Oklahoma Statutes reads as follows:
18
19 This act shall be known and may be cited as the "Food is
19
20 Medicine Act".
20
21 SECTION 2. NEW LAW A new section of law to be codified
21
22 in the Oklahoma Statutes as Section 4002.14a of Title 56, unless
22
23 there is created a duplication in numbering, reads as follows:

1 Subject to receipt of any necessary federal approval for the

2 Food is Medicine Initiative under Section 3 of this act, the
2
3 Oklahoma Health Care Authority shall implement a financial incentive
3
4 for contracted entities who improve health outcomes of covered
4
5 members through nutrition services provided under the initiative.
5
6 SECTION 3. NEW LAW A new section of law to be codified
6
7 in the Oklahoma Statutes as Section 5009.7 of Title 63, unless there
7
8 is created a duplication in numbering, reads as follows:

9 A. The Oklahoma Health Care Authority shall seek any necessary
9
10 federal approval to expand covered nutrition services under the
10
11 state Medicaid program for the purpose of implementing a Food is
11
12 Medicine Initiative.
12
13 B. The Food is Medicine Initiative shall be designed to improve
13
14 health outcomes for Medicaid members through nutrition services and
14
15 reduce the need for medical care.

16 C. Nutrition services covered under the Food is Medicine
16
17 Initiative may include, but are not limited to:

18 1. Case management;

19 2. Nutrition counseling;
19
20 3. Meals or pantry stocking;
20
21 4. Nutrition prescriptions; and
21
22 5. Grocery provisions.

1 SECTION 4. NEW LAW A new section of law to be codified

2 in the Oklahoma Statutes as Section 5-147.2 of Title 70, unless
2
3 there is created a duplication in numbering, reads as follows:

4 The State Department of Education shall provide, to schools who
4
5 apply for grants under the Oklahoma Farm to School Program Act
5
6 codified at Section 5-60.1 et seq. of Title 2 of the Oklahoma
6
7 Statutes, technical assistance with applying for grants and
7
8 administering programs that expand student access to fresh, healthy
8
9 food.
9
10 SECTION 5. This act shall become effective July 1, 2025.
10
11 SECTION 6. It being immediately necessary for the preservation
11
12 of the public peace, health or safety, an emergency is hereby
12
13 declared to exist, by reason whereof this act shall take effect and
13
14 be in full force from and after its passage and approval.
