7   An Act relating to public health; prohibiting

7   manufacture or sale of food containing vaccine or

8   vaccine material; defining term; providing for

8   codification; and declaring an emergency.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.     NEW LAW   A new section of law to be codified

12

13 in the Oklahoma Statutes as Section 1-1332 of Title 63, unless there
13

14 is created a duplication in numbering, reads as follows:
14

15  A. No person or entity in this state shall manufacture, sell,

15

16 or deliver, hold, or offer for sale any food that contains a vaccine
16

17 or vaccine material.

18  B. As used in this section, "vaccine or vaccine material" means

18

19 a substance intended for use in humans to stimulate the production
19

20 of antibodies and provide immunity against disease, prepared from
20

21 the causative agent of a disease, its products, or a synthetic
21

22 substitute, treated to act as an antigen without inducing the
22

23 disease, that is authorized or approved by the United States Food
23

24 and Drug Administration.

1   SECTION 2. It being immediately necessary for the preservation

2 of the public peace, health or safety, an emergency is hereby
2

3 declared to exist, by reason whereof this act shall take effect and
3

4 be in full force from and after its passage and approval.
