7 An Act relating to school choice information;
7 requiring certain dissemination of information prior
8 to annual school enrollment; providing for options to
8 be disclosed; requiring update of material; providing
9 for creation of certain document; providing for
9 codification; providing an effective date; and
10 declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 3-161.1 of Title 70, unless
15
16 there is created a duplication in numbering, reads as follows:
16
17 A. Before annual enrollment of a student in a public school
17
18 district, the school shall provide information to the parent or
18
19 guardian who is enrolling the student concerning all the education
19
20 options available to students within this state, including:
20
21 1. The education options under the Education Open Transfer Act,
21
22 including:
22
23 a. the ability for Oklahoma students to transfer from
23
24 school districts other than their resident school

1 district pursuant to Sections 8-101.2, 8-103, 8-103.1,

2 8-103.2, 8-113 of Title 70 of the Oklahoma Statutes,
2
3 and
3
4 b. the ability for Oklahoma students to transfer to
4
5 different school sites within their resident school
5
6 district pursuant to Section 8-114 of Title 70 of the
6
7 Oklahoma Statutes;

8 2. The education opportunities available under the Oklahoma
8
9 Parental Choice Tax Credit Act, including:
9
10 a. the Oklahoma Parental Choice Tax Credit for other
10
11 means of education pursuant to Sections 10-105 and 28-
11
12 101 of Title 70 of the Oklahoma Statutes, and
12
13 b. the Oklahoma School Choice Tax Credit for private
13
14 school tuition and fees pursuant to Section 28-101 of
14
15 Title 70 of the Oklahoma Statutes;
15
16 3. The education opportunities available under the Oklahoma
16
17 Charter Schools Act, including:
17
18 a. the availability of statewide virtual charter school
18
19 enrollment within the state, and
19
20 b. the existence of physical charter schools within the
20
21 school district and all directly adjacent school
21
22 district boundaries; and

1 4. The education opportunities available under the Lindsey

2 Nicole Henry Scholarship for Students with Disabilities Program
2
3 pursuant to Section 13-101.2 of Title 70 of the Oklahoma Statutes.

4 B. This information shall be posted on the school district
4
5 website throughout the year, updated yearly as new education options
5
6 arise, and be readily available in school office premises for
6
7 distribution to parents inquiring about their education options.
7
8 C. The State Department of Education shall develop a document
8
9 including all information required by this section that applies to
9
10 all public school students within the state for the dissemination of
10
11 information required by this section and shall make it available to
11
12 school districts through its website or other means necessary.
12
13 SECTION 2. This act shall become effective July 1, 2025.
13
14 SECTION 3. It being immediately necessary for the preservation
14
15 of the public peace, health or safety, an emergency is hereby
15
16 declared to exist, by reason whereof this act shall take effect and
16
17 be in full force from and after its passage and approval.
