7 An Act relating to banks and trust companies;
7 prohibiting certain institutions from providing
8 certain information to certain agents; requiring
8 certain notice; establishing certain penalties;
9 establishing certain exceptions; and declaring an
9 emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 3004 of Title 6, unless there is
14
15 created a duplication in numbering, reads as follows:

16 A. A bank, credit union, or financial institution in this state
16
17 shall not provide details regarding the financial accounts or
17
18 financial transactions of an individual, business, or trust in this
18
19 state to any federal agent or agency making such request for
19
20 information.
20
21 B. Upon any request for information, the bank, credit union, or
21
22 financial institution shall notify the owner or manager of the
22
23 individual, business, or trust account of the request within two (2)
23
24 business days. The notification shall include:

1 1. The date and time of the request;

2 2. The requestor, including, but not limited to, the agent and
2
3 any potential agents; and

4 3. Other pertinent information;
4
5 C. Any financial institution that provides personal information
5
6 shall be subject to a fine of Ten Thousand Dollars ($10,000.00) for
6
7 a first offense. A second offense shall subject the financial
7
8 institution to a loss of license to operate in this state.

9 D. Nothing in this section shall be construed to apply to
9
10 requests for information based on warrant, court order, or clearly
10
11 articulated and written probable cause requesting the information.
11
12 SECTION 2. It being immediately necessary for the preservation
12
13 of the public peace, health or safety, an emergency is hereby
13
14 declared to exist, by reason whereof this act shall take effect and
14
15 be in full force from and after its passage and approval.
