7 An Act relating to labor; prohibiting an employer
7 from requiring certain agreement from employee;
8 defining term; allowing employee to seek certain
8 action for violation of section; providing for
9 codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 173.4 of Title 40, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. An employer, as defined in Section 165.1 of Title 40 of the
16
17 Oklahoma Statutes, shall not require an employee, as defined in
17
18 Section 165.1 of Title 40 of the Oklahoma Statutes, or a prospective
18
19 employee to execute or renew a nondisclosure agreement with respect
19
20 to sexual harassment in the workplace as condition of employment.
20
21 As used in this subsection, "sexual harassment" includes, but is not
21
22 limited to, sexual advances, requests for sexual favors, and other
22
23 verbal or physical conduct of a sexual nature that is unwelcome.

1 B. Any employee may bring a civil action against an employer
1
2 who violates this section in a court located in the county in which
2
3 the alleged violation occurred. Such action shall be brought within
3
4 six (6) months after the alleged violation occurred.
4
5 SECTION 2. This act shall become effective November 1, 2025.
