7 An Act relating to schools; amending 70 O.S. 2021,
7 Section 5-132, as amended by Section 1, Chapter 162,
8 O.S.L. 2024 (70 O.S. Supp. 2024, Section 5-132),
8 which relates to adult high school completion;
9 extending age of individuals allowed to complete high
9 school; updating statutory language; allowing a
10 school district that provides a full-time virtual
10 education program to provide instruction to persons
11 up to certain age if the persons receive instruction
11 by certain method; exempting certain students from
12 being included in certain reports; providing an
12 effective date; and declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-132, as
16
17 amended by Section 1, Chapter 162, O.S.L. 2024 (70 O.S. Supp. 2024,
17
18 Section 5-132), is amended to read as follows:

19 Section 5-132. A. Any person who is of legal age and a resident of
19
20 this state, over the age of twenty-one (21) and under the age of
20
21 twenty-six (26) thirty (30), and who has not completed the twelfth
21
22 grade in school shall be given the same educational privileges and
22
23 opportunities provided by law for children over the age of five (5)
23
24 and under the age of twenty-one (21), upon submitting to the board

1 of education of the school district in which the person resides

2 evidence satisfactory to that board showing that during the time
2
3 before he or she was age twenty-one (21) years of age he or she was
3
4 unable to attend school for a definite period or periods of time, by
4
5 reason whereof it was impossible for him or her to complete the
5
6 twelfth grade before reaching the age of twenty-one (21). Provided,
6
7 further, the pupil shall be counted in the average daily attendance
7
8 of the district where he or she attends school during the period of
8
9 time provided for in this section for the purpose of calculating
9
10 State Aid for the district. Provided that, beginning in the 2025-
10
11 2026 school year, persons applying and approved to attend school in
11
12 accordance with the provisions of this subsection shall only be
12
13 eligible if such district offers a full-time virtual education
13
14 program and such persons only utilize the full-time virtual
14
15 education program option for the completion of their high school
15
16 education.

17 B. Any resident of the state who is age nineteen (19) years of
17
18 age or older, who is not enrolled in any high school program, and
18
19 who has not completed the twelfth grade may attend any adult high
19
20 school completion program which is established by a school district
20
21 and approved by the State Board of Career and Technology Education
21
22 if such attendance has the approval of the district offering the
22
23 program. Such attendance shall not be counted in the average daily
23
24 attendance of the district unless the Legislature appropriates

1 monies for adult high school completion programs. Such attendance

2 shall not be counted to meet minimum numbers for accreditation of
2
3 the school district involved, and such students shall not attend
3
4 classes which are a part of the normal class structure of the
4
5 district.

6 C. A person subject to the provisions of subsection A or B of
6
7 this section shall not be required to take the student assessments
7
8 required by Section 1210.508 of this title and shall not be included
8
9 in the reports required by Sections 1210.545 or 24-120.1 of this
9
10 title.

11 SECTION 2. This act shall become effective July 1, 2025.
11
12 SECTION 3. It being immediately necessary for the preservation
12
13 of the public peace, health, or safety, an emergency is hereby
13
14 declared to exist, by reason whereof this act shall take effect and
14
15 be in full force from and after its passage and approval.
