7   An Act relating to appropriations; making an

7   appropriation to the Oklahoma Department of Commerce;

8   stating purpose; providing for implementation of

8   program of compensation related to the Tulsa Race

9   Massacre; providing for collaboration between

9   Oklahoma Department of Commerce and certain

10  committee; providing for membership; creating the

10  Tulsa Race Massacre Compensation Revolving Fund;

11  providing for sources of revenues; providing purposes

11  of fund; providing for expenditures; providing for

12  noncodification; providing for codification;

12  providing an effective date; and declaring an

13  emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17  SECTION 1. There is hereby appropriated to the Oklahoma

17

18 Department of Commerce from any monies not otherwise appropriated
18

19 from the General Revenue Fund of the State Treasury for the fiscal
19

20 year ending June 30, 2025, the sum of Three Hundred Million Dollars
20

21 ($300,000,000.00) to implement a program of reparations for damages
21

22 to persons and property that occurred during the events of
22

23 approximately May 31, 1921, through June 1, 1921, in the City of
23

24 Tulsa, which events shall be known as the "Tulsa Race Massacre".

1   SECTION 2.         NEW LAW  A new section of law not to be

2 codified in the Oklahoma Statutes reads as follows:
2

3   A. The Oklahoma Department of Commerce, with the assistance of

3

4 nonprofit organizations or any other state agency, board,
4

5 commission, or department with information or resources that could
5

6 be of assistance to the Department, shall create and administer a
6

7 program pursuant to which survivors of the Tulsa Race Massacre and
7

8 descendants of victims of the Tulsa Race Massacre may make
8

9 application to and receive payments from the Tulsa Race Massacre
9

10 Compensation Revolving Fund created pursuant to Section 3 of this
10

11 act.
11

12  B. The Oklahoma Department of Commerce shall work in

12

13 conjunction with and receive input from a committee to be composed
13

14 of the following persons:
14

15  1. A member of the Senate whose district includes the Greenwood

15

16 District in Tulsa;
16

17  2. A member of the House of Representatives whose district

17

18 includes the Greenwood District in Tulsa; and
18

19  3. A member to be appointed by the Chief Executive Officer of

19

20 the Oklahoma Department of Commerce.
20

21  C. The member of the Senate shall convene meetings to select

21

22 six other persons to constitute the committee for a total membership
22

23 of nine (9) persons.

1   D. The persons to be selected shall be capable, community-

2 oriented persons representative of the historically and adversely
2

3 affected areas of the City of Tulsa.
3

4   E. The persons selected may include, but shall not be limited

4

5 to, historians, clergy members, attorneys, advocates, accountants,
5

6 and genealogists.
6

7   F. Nonprofit organizations or a state agency, board,

7

8 commission, department, or other entity of state government with
8

9 information or resources may provide assistance to the committee
9

10 members.

11  SECTION 3.       NEW LAW  A new section of law to be codified

11

12 in the Oklahoma Statutes as Section 25001 of Title 74, unless there
12

13 is created a duplication in numbering, reads as follows:
13

14  There is hereby created in the State Treasury a revolving fund

14

15 for the Oklahoma Department of Commerce to be designated the "Tulsa
15

16 Race Massacre Compensation Revolving Fund". The fund shall be a
16

17 continuing fund, not subject to fiscal year limitations, and shall
17

18 consist of all monies received by the Oklahoma Department of
18

19 Commerce from appropriations and such other sources designated for
19

20 deposit in the fund. All monies accruing to the credit of the fund
20

21 are hereby appropriated and may be budgeted and expended by the
21

22 Oklahoma Department of Commerce for the purpose of making payments
22

23 relating to damage to persons and property during the events of
23

24 approximately May 31, 1921, through June 1, 1921, in the City of

1 Tulsa, which events for purposes of this act shall be designated the
1

2 "Tulsa Race Massacre". Expenditures from the fund shall be made
2

3 upon warrants issued by the State Treasurer against claims filed as
3

4 prescribed by law with the Director of the Office of Management and
4

5 Enterprise Services for approval and payment.
5

6   SECTION 4. This act shall become effective July 1, 2025.

6

7   SECTION 5. It being immediately necessary for the preservation

7

8 of the public peace, health or safety, an emergency is hereby
8

9 declared to exist, by reason whereof this act shall take effect and
9

10 be in full force from and after its passage and approval.
