7 An Act relating to county sheriffs; amending 19 O.S.
7 2021, Section 516, which relates to duties and powers
8 as peace officers; amending duties of the county
8 sheriff; providing certain privileges and immunity;
9 and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 19 O.S. 2021, Section 516, is
13
14 amended to read as follows:
14
15 Section 516. A. It shall be the duty of the sheriff,
15
16 undersheriffs and deputies to keep and preserve the peace of their
16
17 respective counties, and to quiet and suppress all affrays, riots
17
18 and unlawful assemblies and insurrections, and to protect the people
18
19 of their county from infringements of the rights guaranteed to the
19
20 people by the Oklahoma Constitution and the United States
20
21 Constitution, for which purpose and for the service of process in
21
22 civil and criminal cases, and in apprehending or securing any person
22
23 for felony or breach of the peace, and for prohibiting agents,
23
24 employees, and officers of the federal government from violating the

1 rights of the people of their county, they and every constable may
1
2 call to their aid such person or persons of their county or other
2
3 citizens of this state as they may deem necessary and organize them
3
4 in such form known as a posse comitatus or other designation for the
4
5 performance of their duties. During such times of service, those
5
6 under such call shall have all the privileges and immunities of the
6
7 sheriff, undersheriff, and deputies. The sheriff shall record the
7
8 names of the those so organized as provided in Section 548 of this
8
9 title.

10 B. The sheriff, in addition to the duties pursuant to
10
11 subsection A of this section, shall coordinate and administer
11
12 courthouse security.

13 SECTION 2. This act shall become effective November 1, 2025.
