7   An Act relating to wreckers and towing services;

7   amending 47 O.S. 2021, Section 962, which relates to

8   the foreclosure of liens; allowing certain persons to

8   have certain possessory lien; and providing an

9   effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY   47 O.S. 2021, Section 962, is

13

14 amended to read as follows:
14

15  Section 962. A. Every person legally entitled to compensation

15

16 for the removal or, storage, or remediation at the scene of an
16

17 accident of any vehicle subject to registration, which vehicle's
17

18 removal has been authorized by any public agency, has a lien on the
18

19 vehicle, dependent on possession. The lien is deemed to arise on
19

20 the date of possession of the vehicle. Any person perfecting a lien
20

21 under this section shall foreclose this lien according to the
21

22 provisions for sale under Sections 908 through 911 of this title.

1   B. Every owner of such vehicle towed or stored pursuant to

2 Section 955 of this title shall be responsible for the total amount
2

3 of the debt for services rendered.
3

4   C. Any wrecker or towing service is authorized to collect from

4

5 the owner, lienholder that seeks possession of a vehicle under a
5

6 security interest, agent, or insurer accepting liability for paying
6

7 the claim for a vehicle or purchasing the vehicle as a total loss
7

8 vehicle, the fee authorized by Section 904 of this title.
8

9   SECTION 2. This act shall become effective November 1, 2025.
