7 An Act relating to schools; amending 70 O.S. 2021,
7 Section 3-151.1, which relates to calculation of high
8 school graduation rates; making certain language
8 applicable to charter schools; updating statutory
9 reference; providing forms of written or electronic
9 confirmation that may be used to remove a student
10 from a cohort; providing an effective date; and
10 declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3-151.1, is
14
15 amended to read as follows:
15
16 Section 3-151.1. A. For purposes of establishing a uniform and
16
17 accurate definition of high school graduation rate for school
17
18 districts and, secondary schools, and charter schools in the state,
18
19 the State Board of Education shall adopt and implement a four-year
19
20 adjusted cohort graduation rate and an extended-year adjusted cohort
20
21 graduation rate. The Board shall utilize and report the four-year
21
22 adjusted cohort graduation rate and the extended-year adjusted
22
23 cohort graduation rate at the charter school, secondary school site,
23
24 the school district, and the state level levels, and the graduation

1 rates shall be reported in the aggregate as well as disaggregated by
1
2 subgroups as required in the Elementary and Secondary Education Act
2
3 of 2001 1965 (ESEA), P.L. No. 107-110 as reauthorized by P.L. No.
3
4 114-95, also known as the No Child Left Behind Act of 2001 Every
4
5 Student Succeeds Act.

6 B. The Board shall use the four-year adjusted cohort graduation
6
7 rate for purposes of determining the high school graduation rate
7
8 indicator for the academic performance data calculation beginning
8
9 with state and district report cards providing results of
9
10 assessments administered in the 2011-2012 school year. The Board
10
11 shall use the four-year adjusted cohort graduation rate for
11
12 establishing the high school graduation rate for measuring alternate
12
13 year percentage growth targets as set forth in Section 3-151.2 of
13
14 this title beginning with the 2012-2013 school year.
14
15 C. The four-year adjusted cohort graduation rate shall be
15
16 defined as the number of students who graduate in four (4) years
16
17 with a standard high school diploma divided by the number of
17
18 students who entered high school four (4) years earlier, adjusted
18
19 for transfers in and out of the school, �migr�s, and deceased
19
20 students. Students who graduate in four (4) years shall include
20
21 students who earn a standard high school diploma at the end of their
21
22 fourth year, before the end of their fourth year, and during a
22
23 summer session immediately following their fourth year. To remove a
23
24 student from a cohort, a charter school or school district shall

1 confirm in writing or by electronic means that a student has

2 transferred out of the school site or, school district, or charter
2
3 school, has emigrated to another country, or is deceased. For a
3
4 student who transfers out of a school site or, school district, or
4
5 charter school, the written or electronic confirmation shall be
5
6 official and document that:

7 1. That the student has enrolled in another school site or,
7
8 school district, charter school, or in an educational program that
8
9 culminates in a high school diploma recognized by a state or private
9
10 higher educational institution accredited or recognized by the
10
11 Oklahoma State Regents for Higher Education for purposes of
11
12 admission to the institution;
12
13 2. That the student's transfer to another school site, another
13
14 school district, a charter school, or a private school in this state
14
15 has been officially documented and recorded in the State Department
15
16 of Education student data system;
16
17 3. That the school site, school district, or charter school
17
18 from which the student transferred received a request for student
18
19 records from a receiving school site, school district, charter
19
20 school, or private school; or
20
21 4. That the school site, school district, or charter school
21
22 received a letter of withdrawal or other written confirmation from
22
23 the parent or legal guardian of the student indicating that he or
23
24 she will be educated pursuant to the other means of education

1 exception provided for in subsection A of Section 10-105 of this
1
2 title.

3 Students not enrolled in a program which culminates in the award
3
4 of a credential recognized by a state or private higher educational
4
5 institution for purposes of admissions shall not be included in the
5
6 graduation rate calculation as set forth in this subsection as a
6
7 student who graduated in four (4) years with a standard high school
7
8 diploma but shall be included in the number of students who entered
8
9 high school four (4) years earlier.

10 D. The extended-year adjusted cohort graduation rate shall be
10
11 defined as the number of students who graduate in four (4) years or
11
12 five (5) years with a high school diploma divided by the number of
12
13 students who form the adjusted cohort for the four-year graduation
13
14 rate as calculated as provided for in subsection C of this section,
14
15 provided that the adjustments add to the cohort all students who
15
16 transfer into the cohort by the end of the year of graduation being
16
17 considered and subtract students who transfer out, emigrate to
17
18 another country, or are deceased by the end of that year. The
18
19 extended-year adjusted cohort graduation rate shall be reported
19
20 separately from the four-year adjusted cohort graduation rate.
20
21 SECTION 2. This act shall become effective July 1, 2025.
21
22 SECTION 3. It being immediately necessary for the preservation
22
23 of the public peace, health, or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and

2 be in full force from and after its passage and approval.
