7 An Act relating to the Construction Industries Board;
7 amending 59 O.S. 2021, Section 1000.4a, as amended by
8 Section 3, Chapter 185, O.S.L. 2023 (59 O.S. Supp.
8 2024, Section 1000.4a), which relates to additional
9 powers of the Board; modifying eligibility of certain
9 educational institutions to enter into certain
10 contracts; updating statutory language; updating
10 statutory references; and providing an effective
11 date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1000.4a, as
15
16 amended by Section 3, Chapter 185, O.S.L. 2023 (59 O.S. Supp. 2024,
16
17 Section 1000.4a), is amended to read as follows:
17
18 Section 1000.4a. A. The Construction Industries Board shall
18
19 have the additional powers to:
19
20 1. Receive and convey information relating to the skilled
20
21 trades regulated by the Construction Industries Board including, but
21
22 not limited to, workforce development; and
22
23 2. Enter into contracts with the Oklahoma Department of Career
23
24 and Technology Education or any Oklahoma State Board of Career and

1 Technology Education fully accredited vocational or technical

2 school, or any accredited system of education institution in the
2
3 State of Oklahoma this state receiving state appropriations and
3
4 offering programs in primary, secondary and, or postsecondary
4
5 instruction that provide electrical, mechanical, plumbing or roofing
5
6 trade coursework for any of the following purposes, or combination
6
7 thereof:

8 a. developing and implementing instructional courses on
8
9 Oklahoma Statutes and rules that govern the
9
10 electrical, mechanical, plumbing and roofing trades,
10
11 which courses can be in conjunction with instruction
11
12 in performing trade work or instruction on statewide-
12
13 adopted trade codes, or both, for the advancement of
13
14 the electrical, mechanical, plumbing and roofing
14
15 trades, or
15
16 b. developing and implementing a workforce development
16
17 program that will create interest in the pursuit of a
17
18 skilled trade career and public awareness. The
18
19 workforce development program may consist of, but is
19
20 not limited to, use of the Internet, community and
20
21 school presentations, and research and instruction on
21
22 the electrical, mechanical, plumbing and roofing
22
23 trades, and public information campaigns.

1 B. All contracts pursuant to this section shall be approved by
1
2 the Construction Industries Board in accordance with the Oklahoma
2
3 Open Meeting Act. Costs of the contracts for education and
3
4 workforce development programs shall be paid from the Skilled Trade
4
5 Education and Workforce Development Fund established herein and
5
6 funded by administrative fines or penalties as described in this
6
7 section. Applications for proposals are to be submitted to the
7
8 Board on forms provided requiring sufficient justification and
8
9 information to evaluate costs, return on investment, value, and
9
10 viability of the proposal. Any contracts will include the
10
11 requirement that the recipient of the funds will, upon the
11
12 completion of the contract, provide a written report to the Board
12
13 providing an accounting of expenditures, describing an explanation
13
14 of the funds used for the services provided and the success of
14
15 outreach demonstrating a return on the investment including, but not
15
16 limited to, an accounting of accomplishments.

17 C. Fines or penalties collected by the Board and deposited in
17
18 the Oklahoma Mechanical Licensing Revolving Fund, the Electrical
18
19 Revolving Fund, the Plumbing Licensing Revolving Fund and the
19
20 Roofing Contractor Registration Revolving Fund may be transferred to
20
21 the Skilled Trade Education and Workforce Development Fund created
21
22 in subsection E of this section for the following purposes:

1 1. To develop instructional materials on Oklahoma laws,
1
2 statutes and rules, as they relate to the plumbing, mechanical,
2
3 electrical and roofing trades and state licensing standards;
3
4 2. To cover the cost of equipment, materials, personnel and any
4
5 other costs of developing and implementing the trade curriculum; and
5
6 3. To cover the cost of equipment, materials, personnel and any
6
7 other costs of developing and implementing the workforce development
7
8 program used to promote the plumbing, mechanical, electrical and
8
9 roofing trades as a career in Oklahoma.

10 D. The Skilled Trade Education and Workforce Development Fund
10
11 monies shall be used only for the advancement of trade-related
11
12 education and workforce development, and only if available based
12
13 upon statutory limitations.
13
14 E. 1. There is hereby created in the State Treasury a
14
15 revolving fund for the Construction Industries Board to be
15
16 designated the "Skilled Trade Education and Workforce Development
16
17 Fund". The fund shall be a continuing fund, not subject to fiscal
17
18 year limitations. The fund shall consist of an annual transfer of
18
19 fully adjudicated fine revenue received in the Oklahoma Mechanical
19
20 Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
20
21 Licensing Revolving Fund or Roofing Contractor Registration
21
22 Revolving Fund as determined pursuant to this section. Funds may be
22
23 transferred only from the prior fiscal year.

1 2. If actual receipts, not including fine receipts, exceed
1
2 actual expenses and outstanding encumbrances, then one hundred
2
3 percent (100%) of all fully adjudicated fine revenue received shall
3
4 be transferred from each specific trade revolving fund: the
4
5 Oklahoma Mechanical Licensing Revolving Fund, Electrical Revolving
5
6 Fund, Plumbing Licensing Revolving Fund or Roofing Contractor
6
7 Registration Revolving Fund.

8 3. If at any time the receipts in the Oklahoma Mechanical
8
9 Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
9
10 Licensing Revolving Fund or Roofing Contractor Registration
10
11 Revolving Fund, not including fine receipts, are less than actual
11
12 expenses and outstanding encumbrances, then the difference of fine
12
13 receipts over actual expenses and outstanding encumbrances, if any,
13
14 shall be transferred.
14
15 4. If at any time the annual receipts in the Oklahoma
15
16 Mechanical Licensing Revolving Fund, Electrical Revolving Fund,
16
17 Plumbing Licensing Revolving Fund or Roofing Contractor Registration
17
18 Revolving Fund, including fine receipts, are less than the actual
18
19 expenses and outstanding encumbrances, there shall be no transfer of
19
20 funds for that period.
20
21 5. All monies accruing to the credit of the Skilled Trade
21
22 Education and Workforce Development Fund may be budgeted and
22
23 expended by the Construction Industries Board for workforce
23
24 development as it relates to the skilled trades and to contract for

1 the services identified in this act section and Sections 1018,
1
2 1151.20, 1694, and 1850.13 of this title. Expenditures from the
2
3 fund shall be made upon warrants issued by the State Treasurer
3
4 against claims filed as prescribed by law with the Director of the
4
5 Office of Management and Enterprise Services for approval and
5
6 payment.

7 6. All unexpended or outstanding funds from the Skilled Trade
7
8 Education and Workforce Development Funds Fund from any written
8
9 agreement where work or services have not been previously approved
9
10 by specific quote or cost estimate and have not been performed
10
11 within eighteen (18) months of the date the agreement was signed are
11
12 hereby released from the agreement and are available for future
12
13 agreements approved by the Board pursuant to this act section and
13
14 Sections 1000.2 and 1000.4 of this title, except for specific
14
15 quotes, estimates, or invoices that previously have been approved
15
16 for payment, and for which performance has been initiated, and
16
17 completed within twenty-four (24) months of the signed agreement.
17
18 SECTION 2. This act shall become effective November 1, 2025.
